Since returning my aq I heard nothing for weeks then received a letter on the 7th August saying that my case, as a result of an order was being transferred to Cardiff county court ( from my local court).
Have now received a letter yesterday, stating
BEFORE HIS HONOUR JUDGE G HINKINBOTTOM
Upon reading the Allocation Questionaires and file
IT IS ORDERED THAT
1. This claimgiving rise to important legal issues of general importance, it is allocated to the Multi-Track and transferred to Cardiff county court for case management.
2. By 4pm on 1 September 2006, each party shall serve and file propsed directions through to trial. Unless either party requests a hearing, the court will then give directions through to trial without a hearing.
3. All matters relating to this case shall be reserved to the Designated Circuit Judge, unless expressly released by him.
4. Any party may apply tp set aside vary or stay this order pursuant to CPR Rule 3.3 (5) & (6).
Has anyone else had a letter like this? Could really do with some advice and help on what I am to supply the judge at this point. Getting a bit worried now!

| | Site Team | Re: On a mission but nervous My initial gut feeling is that you will now receive a very fast settlement, however I would suggest that you need to go through your claim thoroughly, and read through the information again in the FAQ's to ensure that you fully understand the legal arguments.
In the meantime I will alert admin to your case.

| Re: On a mission but nervous I think that this is an extrordinarily important development.
It seems that we have a judge here who may be aware of what is going on and has decided to push it to the limit.
He has ordered a multi-track trial which means standard disclosure from the bank.
You may not realise it but this order has been made by a circuit judge.
This probably means that a District judge noticed the case, realise what it signified and referred it to a circuit judge who then made the order.
I expect that that the bank will settle but it shows that maybe some judges are getting fed up and that they understand where the trouble is coming from.
I think that this development is extremly positive. I do not think that it is anti-claimant.
Also, I feel (only a feeling) that because the court has exercised its own discretion to allocate the case to the Multitrack on a low value case, that even if Twinkle loses it will be unlikely that the court awards costs against him.

| Re: On a mission but nervous Try not to worry Twinkle. We are all right behind you, although it is still quite likely that you will get settlement pretty soon I imagine. If not I am sure that BankFodder makes sure that you are well prepared for what might lie ahead.

After some good advice and serious thinking I have decided to carry on with my claim, and as of yesterday, Barclays and the courts received my proposed directions through to trial. As some of you know my case was put onto Multi Track by the judge.
Barclays have until Friday 4pm to do the same, so here I wait  |
