Carly, they aren't playing ball with my closed business account. In not so many words they told me to f*?! off.
So they have 6 days left of LBA limit before moneyclaim goes in.

Re: Barclays Business Action Taken

made a bit of a cock up here! I have got quite a few of these all due on the same days except this one. When I was filing my money claims on line I accidentally did this one as well. So although I stipulated in my LBA they had 14 days I have actually only given them 10. can't see there is much I can do about it now and it's doubtful they were ever going to pay out anyway, so I suppose I will just have to go with it. Has anyone else done this by accident?

Good luck.
I've heard nothing further despite my LBA. My clainm is going in on Friday 12th. Little delayed due to timings of me being here to process, but hell, Barclays may think they have got away with it for a few days longer!

Nevermind, the few days late that you file yours compensates for the 4 days early I put my claim in!!!
Good luck!

Have received a letter from the court yesterday 18/5/06, saying that Barclays have entered a judgement to change their address. I made my claim to the churchill place address. They haven't given me any details of what the new address is, so i am assuming that it is because it is a business account. When I find out the address I will let you know, because I have a feeling that business claims will need to be made to that address.
Either that or this is just another delay tactic, but it doesn't seemed to have delayed anything so far.
They have filed acknowledgement of service and have until 27th May now to enter their defence.

They can't do that. The business address of Barclays is that registered at Companies House. This is a legal requirement so that claimants know where to send legal documents! Do you have letters from Barclays (usually at foot of page) showing the registered address?
Object to the court. Its an internal affair, nothing to do with the court.

Unless of course they have changed the address at Companies House ( I doubt it)

Default Re: Barclays Business Action Taken

well this is what I thought, there is only one registered address, Churchill place, which is where I filed my claim to. This is the letter I received,

'The defendant has advised us of a change of address. We have updated our records; however we can not update the website. As a result of this you will not be able to proceed to judgement or issue a warrant online.

To proceed to judgement you will need to instruct the Court manually, using form N225-Entry of judgement by default or admission.

To issue a warrant you will need to request (by email or post) for the case to be transfered to the defendant's local court for a manual warrant.'

I am sure that the address is right, so what is this all about?!! It certainly has made things more complicated because now I can't do anything on line and will have to wait for post etc.

Any advice anyone?

Don#t worry. This may or may not be some cunning ploy etc by the banks, but it won't make any difference unless they don't enter a defence and you need to enter a judgement by default. In which case you can download the N225 from http://www.hmcourts-service.gov.uk/ and they will settle in full before that stage.

I would fill in the form to get the court changed to a local one, assuming you have easy access to your local County Court. You an then submit judgement, warrents etc by hand on the same day.

It may also spook Barclays as it will show that you are on the ball with your legal stuff.
Barclays, as an organisation, can't request the court change (that is my understanding anyway).
Did you ask the court how Barclays can change their address and why they are doing it?
It really does look like another procrastination attempt by Barclays. Why don't you contact Barclays seeking the reason for a change of address? If they can't or won't give a reason, mention that you will present this to the Court as evidence of being unreasonable in attempting to resolve the matter before it reaches the Court?

As at 11.00am this morning, the register at Companies House were giving Barclays Bank PLC's registered address as 1 churchill place.

Sounds like more time wasting to me.

Angry Re: Barclays Business Action Taken

Alike my Abbey claim, I discovered today that my claim is set for an allocation hearing on 8th September. The judge has lumped in an hour and a half's worth of people claiming bank charges and we are all being seen at 2pm-classic!!

Much alike my Abbey a/c I am really hoping it doesn't come to this and that I receive an offer before then as my company has closed and companies house will soon close my a/c. Interestingly though, I haven't had any offers or anything from Barclays at all. All the other banks had made me an offer or settled by now, but I have had no correspondence whatsoever from Barclays-isn't very inspiring

Thanks Karne, I have posted on her thread. How bizarre!!!
I wonder how any exactly are going to this hearing and why Barclays are dragging it out so much longer with no offers at all.

All very intriguing!!

Yeah my Abbey one was the same time too, so there could be loads of us if all the banks are in there!!!!

Abbey however are settling with everyone, I am just curious why Barclays are taking it so much further and not making any contact at all? Do they think they have a chance?!
