I really dont want to print off a tree for the hearing.... but what essentials should I take?? Can anyone advise....??


Is there anything else (last ditch attempt to mediate a settlement to prevent the court wasting its time ) I should do???

Best of luck innocent, I'm well on the way to claiming of Barclays and was planning on paying off my BC before going for them but i might aswell get the ball rolling ASAP.

What interest are you claiming? 8% or the contractual 27% ?

I would say, innocent, that you need to prepare yourself as if it were the full hearing. That way they can't catch you out with anything you're not expecting. So make sure you are fully aware of the legal basis of your claim and go with a full set of notes of anything you might want to refer to.

MIDWAY THRU PHONE SETTLEMENT.... ADVICE NEEDED


Well, well, well

At 11.20 this morning all my phones starting ringing; it was an Anthony Lombardi; very ploite; from Barclays (0207 116 4523) who wanted to setting for £296.... he did sound rather panicked....

He apologised for an "administrative error" and delay...

I questioned the amount and he listeneded to my figure and said

"Ok ok fine... we don't have time to calculate the interest so any figure that sounds reasonable is fine.... so Ill refund £306.99"

Now....

He offered to refund the card (he knew it was at 0 balance.... he had time to check this) I refused...

I want a cheque and a confirmation letter I said

Currently AWAITING ON FAX AND PHONE CALL BACK

Any suggestions???

Should I ring the court only to delay the case???


There is no chance the cheque will be cleared by Monday (I will require it by Monday though)....


Whats everyone think????

Fax receieved and returned; I crossed out the confidentiality bit of course;

They will send the cheque today by recorded delivery; and I will contact the court to delay proceedings....

Hopefully, this time next week, I can cancel the whole thing....

3 won now! (Can't believe Barclays have been the smallest amount and taken the longest time.... right to the wire)

it was so close...... but goes to show they dont want court....

I have been advised by the court to still show up to make sure barclays dont change their mind, and to explain to the judge its settled now...

Will update this thread, with what happens and cheque arrival and clearance etc....

PRELIMINARY HEARING COURT DATE ARRIVED AND NO CHEQUE!!

Under advice from the court, last friday, when the settlement was (suddenly) offered, late by Barclays (because of an administrative error lol), and in the absence of the cheque arriving (by the slowest ) recorded delivery...

today

* I contacted Barclays again and left a message asking them to contact me and leave tracking information on the cheque "in the post".

I believe they rang back when my phone was off in the court room; they leaft no messages; I will try try try (if need be) again tomorrow

* I attended court to show the faxed settlement letter and explain the current situation. The judge explained he was very impressed with me and simply was amazingly helpful on my first visit to court. Ok, he believes, I believe, I will get the cheque and all will be ok but.... just in case

he has not 'stayed' the case, because, he spent some time explaining to me this should in reality freeze the case at this point... and he wanted it to continue to payment to me....

he has '(something) adjourned' the case for 6 months. Which means after 5 months the case will stop. But if, AT ANY POINT, I wanted to re-start the case I could quickly, if Barclays did not pay!!!

Just me and the judge in the court-room and quite a brief but remarkable experience; giving me nothing but encouragement for any future visits.

The judge did say at one point "I (innocent) probably know much more than him (the judge) just how big and effective this campaign is"....

well done innocent. If only all judges were like that! keep pestering for that cheque, if they start mucking around you are in a good strong position so I'd give them a deadline. On mine I gave B'card my bank account details and insisted they paid it in by CHAPS payment the same day, so they can do it.

Just for those technically minded I received a General form of Juedgement today after attending the court hearing on 19th February 2007....

"thankyou" your honour

IT IS ORDERED THAT

1. Proceedings adjourned generally with liberity to restore on Defendant having agreed to pay Claimaint 307.99 in full and final settlement of claim including interest and costs.
2. If no application to restore is made by 19th August 2007 the claim to be struck out with no order for costs.
