| | Platinum Account Customer | Re: Bookworm v Barclaycard Hmm, know what you mean... the lovely chap I have been chatting to seems under the impression that if we go to court, he'll be able to say to the judge that they have agreed to settle, but disagree about the interest, and will ask the judge to decide on that... I did mention that first, there would be the small matter of deciding on penalties, and that siince their defence doesn't argue against the interest at all, but just argues they're not penalties, they could have a wee problem there...
That reminds me, I need to update my spreadsheet, the numbers have changed again with all that faffing about. The way they go on about it, you'd think it's coming out of their own wallet!

| | Platinum Account Customer | Re: Bookworm v Barclaycard ***she's only been and won it! :-D*** Well, hearing set for 11.00, young little thing (aren't barristers young these days?  ) arrived at 10.55 and proceeded to drag me to an obsure corner, where she tried to barter me down again, same argument, we don't think your calculations are correct, interest too high. Ok then, said I yet again, tell me what the correct amountis, and I won't argue! She tried to up the amount a bit more. Didn't work, so she said she would go get the settlement letter then.
The fax machine had a long queue of people, so she couldn't get the letter in time for us to settle before we were called in, so we went in for about 2 mns, just to say that they were settling, and to ask the judge to adjourn in case of problems with settlement, which the judge agreed to.
Out again, she went and got the letter (I had reminded her not to try and enter a confidentiality clause!) and that was it.
Judge scared me a bit, though, because she started on "So, about staying this case..." WHAT?  Thankfully, Miss Barrister informed her that actually no, they weren't applying for a stay, as credit card charges don't come under test case.
(I had half-expected them to try all the same, so had a folder-full of objections, OFT press releases etc to fight it!)
All done and dusted in a very short time, after months and months of prevarication, evasions, blocks and half-truths. £756.29, and it shall be mine.  |
