Hi all,
Have just received my 2nd letter from ****** Barclays.
It is basically the same one they sent out before .
"If you would like to reconsider our offer for a refund of £1000,please sign and return the acceptance form enclosed........I apologise in advance as ity would appear we are unable to reach an amicable resolution.
If you wish to discuss this letter,or feel there are further issues I need to consider,please contact me on my direct tel no 020 7116 3994.If you are dissatisfied with my proposal for resolving your complaint you may ultimately be eligible to refer to the Financial Ombudsman Servie."

Help!!! Are they just stalling for time?? If I keep going can I end up with nothing???

	The Financial Ombudsman Service For the most part, don't bother. The Ombudsman is an industry arranged service which is under-resourced, takes too long, lacks clear transparency. You have no idea what evidence the FOS has received from the bank or how your complain has really been handled. The FOS is the preferred complaints route for the banking industry. The county court is to be preferred by consumers for its speed, openness, the quality of its awards and also because it will award 8% interest on top of any damages won by you. The Ombudsman should normally be used to solving little technical difficulties or customer service problems which you have expereinced with your bank.

The advice would be to reject the offer and continue with your claim to get all your money.

However, it's your money and your decision.

If you read around the forum, you will see plenty of cases in which people have stood their ground, rejected an offer and then get the claim in full.

Of course there is no guarantee and you must be prepared to go to court.

Hi,
I don't believe it(thinking I sound a bit like Victor Meldrew
I have just incurred another now £30.00 fine. Completely my fault forgot to do online banking.
Can I add this charge onto the ones I am already claiming or do I have to start from scratch??????
I did try calling them but said they would not refund it! ;-(

You can keep changing the amount until right up to the court claim you file!

Up until today I haven't accepted the money offer yet as been a bit of a chicken and wanted to see how others got on.

	Bank Charges You should have started your claim for your bank charges by now. Don't wait. You should send your bank a Subject Acess Request asking for all personal data they hold on you - not just statements. You should calculate all of your bank charges and related interest as far back as 1995. You should send your bank a demand for a refund giving them 7 days. You should commence your legal action adding 8% statutory interest. If you wait for the outcome of the test case, you may not be able to claim like this. you may not be able to claim interest. You may only be offered the difference between the charge and the OFT "fair charge". The repayment scheme will try to limit you to refinds from 2001 only. A repayment scheme will not deal with any bank charges related defaults on the credit register whereas in a court action you can ask for these to be removed and to be compensated for the damage caused to you and your family by them. You should also write to the bank and to the CRA and put all charges related credit entries in disupte and warn them that you will want them removed from the Register when the test case is over. Warn them also that you are likely to be seeking compensation for these wrongful data entries. Full and final settlement Have you previously accepted a partial repayment of your bank charges in full settlement? You will still be able to claim the rest of your money back after the Test case is decided. Get all your information back to 1995 and put in your claim now.

Yesterday(my post comes very late!!) I received the following from the beautiful Barclays...

Thank-you ..blah.blah..
I am sorry you remain unhappy with our response to your complaint and note that whilst you are accepting the amount offered, that is £****, you be seeking the remaining balance in the County Court.
I would like to take this opportunity to clarify the amount offered was in full and final settlement of your claim. I am therefore unwilling to adhere to your request to re-imburse you with the amount offered, and it is with regret that you will now be proceeding to the Count Court for the full amount.
I appreciate this is not the response you have been hoping for, but I trust I have clarified the Bank's position.

I will file claim on 20th as have to wait until pay day.
Has anyone had any success with these guys yet??
Seems strange that they are willing to take this further as it is going to cost them more...Unless they know something we don't.
