At last, word from Barclays today. They are willing to offer me £800 as a gesture of goodwill. As my claim is for approx £3824, I will be holding out. But, they include an envelope for me to accept this offer, saying that if they do not hear from me within 8 weeks, they will assume complaint is resolved and close file. I have already filed my claim, and it has been acknowledged, so do I just ignore that now and just wait for the claim to proceed?

You will get an allocation queestionaire, fill it in send it back and usually they will pay up on the deadline!

You will prob get a letter from Keith Jeramiah Saying they are going to defend dont worry, theres 7 others already had that letter, I started a list on the Barclays action forum!

Just sit tight!

have just received questionnaire along with transfer of proceedings document asking for another £100 to lambeth county court. Do I pay up?
Is the defence a standard format. I only want to claim for paid referral fees and unpaid direct debit fees, plus the interest on those -not the unauthorised borrowing fee. I am worried now that i was not specific enough with my claim.
i wrote;

I am claiming the return of money taken by
the defendant in the way of charges over the
last 6 years plus the interest they have
levied on those charges. The bank's charges
are a disproportionate penalty and therefore
unenforceable as they are contrary to common
law. Further, as a disproportionate penalty
they are invalid under the Unfair (Contracts)
Terms Act 1977 s.4 and under the Unfair Terms
in Consumer Contracts Regulations 1999, Para.
8 and sch.2(1)(e). In the event that the
charges are not a penalty then they are
unreasonable within the meaning of the Supply
of Goods and Services Act 1982 s.15.
The claimant claims interest under section 69
of the County Courts Act 1984 at the rate of
8% a year from 11.04.00 to 20.04.06,
(£629.19} and also interest at the same rate
up to the date of judgment or earlier payment
at a daily rate of 0.7029.
Any advice?

also, in their defence they ask for proof of each charge.I have gone back over six years of statements and filled in the form I got off the website -would I take that to court if required, or send it to them now?

Do I have to fill in the "Defence and counterclaim " form? or just the questionnaire

Default current claim forms and process

We are working on a form to give you guidance which will hopefully be in FAQs very soon. If you are getting too close to the deadline for responding to it, please PM BankFodder and he will help you out.

Don't do this unless you really are running out of time though, as he is incredibly busy, as I'm sure you can appreciate.

John

Default waiting for court dates

does anyone know how long it takes to be given a court date. I sent back my allocations questionaire on the 13th june, but haven't heard anything form bank or court. I didn't give the bank the chance to make an offer, i thought it simpler to just send the form. I've heard nothing -should i be worried/

i think i am guilty of a 'mistake'
i failed to send the bank the spreadsheet detailing penalties, but have subsequently forwarded these to bank and court. I also did not enter into a debate with the bank befor filing claim and before sending allocations questionnaire back. will this jeapordise my claim. eukhhh....
what other info could the court require`?
