Default Lickthewallfatboy V Barclaycard SETTLED out of court

Got all the bumph in today from Barclaycard,including the Data Protection Act pre 2004 sod off letter and the reams of computer print outs.

I have decided to use this against them.The print outs list the number of months overlimit and number of missed payments,so I'm multiplying that by the amount
they levy as a charge and putting in a claim for repayment.I also included in the letter that if I discover any further charges have been levied after i have received the full information as per Data Protection Act request,I will be claiming for those as well!!

yes it is.I have been somewhat sidelined by a couple of biggish claims with the Northern Bank and MBNA,so I posted when I had something concrete to go on.

just go to the top of the page,find "user CP",click on that,then find "edit signature",click on that and write down what you want and save it.
And there you have it!

wife just got the standard delaying letter with the hoary old microfiche argument!!

ALSO offering us statements at £3 a go.....ROFLMAO

can we now do this simultaneously?-

1. estimate total charges and put in repayment request

and
2.letter to Information Commissioner commissioner/court action for Data Protection Act non compliance

if I take them to court,what are the damages they could realistically award us?

Hi there

this is exactly the situation Im in.

See my other thread near the top with the exclaimation mark to see where Im going.

I dont know about prosecuting under the Data Protection Act for non compliance, although I did speak with Rachel Sheils yesterday and I feel for her, clearly she has been fed a crock of sh*t and she knows its b*******s as much as I do.

Happy to sue thier asses , but struggling to get my head around how to do it.

just another thought-do I still have to give them the full deadline period before I proceed,or can I batter on now that they have refused again in writing?

We've had enough of this crowd of crooks and their stalling and ignoring tactics.

I've gone through the crappy print out again,and as they have ignored a letter about the Data Protection Act breach,I have totted up everything that even remotely resembles a charge,and bunged in an LBA for £950,and if they want to dispute it,let them prove me wrong.

Had it up to here with pussyfooting around with Barclaycard.Time to call their bluff and end this.

letter received this morning from Katrina Downs the "customer relationship manager",who says they are investigating our "dissatisfaction" and that they are aiming to resolve matters by 28th July.

At least they got the right month-just a pity that they now have 6 days to pay up or shut up.....

I am in same boat fed up with wasting time and sent estimated claim in for £1900 ish based on 2 years statements they sent me x 3 for 6 years... let us see what has happens.... moneyclaim filed yesterday..

claim lodged on sunday evening in NI Courts online for £950 estimated charges plus costs,and an invitation to let the court decide on interest,as I've had to estimate the charges from the dreaded printout.
