Where has the most advance claims got to? has a court date been set?

Well according to the survey results almost 15 grand has already been refunded by Barclaycard !!

The overall total BTW is fast approaching £1m though as keeps being pointed out is believed to be much more than this already....

average stage at which charges have been returned is stage 1

very good compared to Halifax customers (stage 3)
looking at the results of the survey the Halifax refunds account for almost 25% of all the refunds put together as it stands at the moment 222.000+

Barclaycard has entered a defence for my claim of £40. I'm prepared to go to court but will be very surprised if I do due to the small amount I'm claiming. Guess it's scare tactics but having already taken Halifax and Capital One I'm not going to start backing down now!

I realsie that they the survey results indicate they are returning money but are these patial or full refunds?

I have yet to see a thread in which someone has stated that they have had a settlement or havent seen a settled case in the litigation section.

Is this because people are signing a confidentiality agreement or because we havent got to the stage where they have settled yet?

Good point IF you cant find this info lets ask everyone.

There is no obligation to sign a conf agreement in fact I have seen lots of posts advising against doing so.


Any settled Barclays claims want to throw some light on this ?

It seems to me that the majority of the posts in this forum are discussing their inability to access the correct Data Protection Act info from Barclaycard, and it seems to be taking a long time time to clear them up. Of those that do take them to court, they do seem to be filing defenses and getting courts allocated.

I wonder if the lack of settled cases is due to the number of claims being delayed and therefore less being at the court stage than other forums?

I also wonder whether the recent change of their fees to £12, and the number of defenses entered that they may be considering attending court and using the OFT guidance as a defence?

Will have to wait and see I guess. I have started proceedings, and they have until next Monday to reply. I know that there is someone on here that has a court date set for 1/9/06, it would be interesting to know whether there are any earlier...

looking at the survey results again barclaycard have moved from stage 1 to stage 2......looks like they have changed tac slightly.
They are still showing as having the least claims after virgin.
Considering the size of their operations (and remember that it was Barclaycard that first issued credit cards in the UK ) its a bit of a mystery as to why the survey figures are so low.
I am more inclined to think there are reasons for this..........reasons maybe that we wont be hearing about........at least for the moment.

On further reflection barry I just realised that the link you posted is for barclays cases and not barclaycard, I particular wouldnt if anyone has a court date set gainst them as they seem to be a tough nut to crack.

I have just had a look on another site.........which has some prominence.
On the settled claims there is an e mail.
The person says he was asked to sign a confidentiality clause as were all his family!
They paid out in full for over 4k.

He will only state that the bank is a big high street one.
By a very strange coincedence there appears to be a certain name missing from all the other settled claims who have posted details.

I dont think you need any guesses.but what follows A and comes before C?

Looks like this answers in some way a question a lot of people are asking.

Hi there, whats the legal standing if you are 'asked' to sign a confidentiality agreement?

Can you refuse but still claim the money back or can a court force you and whoever to sign it?

If you can refuse to sign it, will the bank (or whoever you are suing) get you in other ways such as closing your account or raising overdraft interest rates etc?

There is no legal obligation to sign.........its entirely up to you to agree or decline.
Ive not heard of anyone not getting the money after refusing.

In fact I have heard it hinted you could agree additional compensation as a condition of signing........though the bank has no legal obligation to agree.

The confidentiality clause would though prevent you from disclosing any information about the case......if you breached the agreement later you could end up paying your claim money back and more besides for breaking a legally binding document.
Your family may also be called to make the same undertaking.

So its up to you.
