Hi, Thanks,
I tried the main number again this morning and it worked, guess they had a phone line fault yesterday.
I was able to pay off my account before the 6 months were up, so hopefully that's it finished with.

Thread revival

I have just got a statement from CFS/BPF and have checked out the charges and they are very substantial.

I am about to write the letter to them but was wondering did you just use the standard bank charges letter or did you use a specialised one? If so would it be possible to get a copy of it?

Request for repayment of charges


Dear Sir/Madam,

ACCOUNT XXXXXXXXX

Over the last four months you have added charges to my account purportedly to cover letters sent to me about my account. Each charge is for £22.50 – they are listed in the attached schedule.

The letters you sent have all been automatically generated – even the signatures are added by the computer. As such, the total cost to you of sending each letter cannot be more than 35p including stationary and postage.

This means that the charges substantially exceed your costs in handling these events and therefore amount to penalty charges, which are contrary to common law and to the Unfair Terms in Consumer Contracts Regulations 1999. Calling them ‘letter charges’ just makes them disguised penalties as defined in the 1999 regulations.
This letter constitutes a formal request for you to repay £112.50 in unlawful charges.

This letter is not a complaint and so I do not expect it to be treated as such. Rather, I expect a positive response within 14 days accepting my request in principle. I believe that this is more than sufficient for a large company such as yours with dedicated staff and large resources.
