For avoidance of doubt () what they paid was all the charges they made for letters telling my son he was behind with payments, one or two late payment charges, interest and court fees.

I have told Clydesdale to go forth and multiply as their charges are more than the o/s balance. Haven't heard anything for a month or so - perhaps they finally got the message.

When I was up the creek without a wooden thing Clydesdale were the only creditor who refused to freeze interest - they reduced it but would not freeze it. I have boatloads (pardon the pun) of letters telling me that their company policy is blah blah - they seem to think they are above everyone else for some unknown reason

Another small victory - Barclays keep ringing me for my son even though I told them he doesn't live here. One 'senir staff member' told me they intended to carry on ringing me as it was the only number they had for him. So I sent the following letter to their legal department:

The above account belongs to son4064 who used to reside at the above address but no longer does so.

Barclays persistently phone son on my telephone number (xxxx xxxxxxx) concerning collection on this account even though I have told Barclays on a number of occasions that son is no longer at this address and requested that no more calls are made to my telephone number.

I received such a call today and again repeated my request that this number should not be called, as son no longer lives here. The person I spoke to claimed to be a senior member of staff and, on that basis, refused to let me speak to a supervisor. He also said that it was his intention to carry on calling this number as it was the only number Barclays had. It is clear that Barclays’ policy is to harass the nearest person they can get to if they are unable to communicate with a client.

I would like to point out that this behaviour constitutes harassment under ss1&2 of the Protection from Harassment Act 1997 –

1 Prohibition of harassment
(1) A person must not pursue a course of conduct—
(a) which amounts to harassment of another, and
(b) which he knows or ought to know amounts to harassment of the other.
(2) For the purposes of this section, the person whose course of conduct is in question ought to know that it amounts to harassment of another if a reasonable person in possession of the same information would think the course of conduct amounted to harassment of the other…

2 Offence of harassment
(1) A person who pursues a course of conduct in breach of section 1 is guilty of an offence.
(2) A person guilty of an offence under this section is liable on summary conviction to imprisonment for a term not exceeding six months, or a fine not exceeding level 5 on the standard scale, or both...

Further, this behaviour is also an offence under s127(2)(c) of the Communications 2003 –

127 Improper use of public electronic communications network

(2) A person is guilty of an offence if, for the purpose of causing annoyance, inconvenience or needless anxiety to another, he—

(c) persistently makes use of a public electronic communications network.
(3) A person guilty of an offence under this section shall be liable, on summary conviction, to imprisonment for a term not exceeding six months or to a fine not exceeding level 5 on the standard scale, or to both...

I have written to you so that you can impress the seriousness of their actions on the department concerned, since the person who phoned me was obviously ignorant in this respect.

If I receive any further calls relating to this matter, I will give the facts to the local police, naming the Barclays employees involved and any senior managers I deem to be responsible. I also reserve the right to civil remedy under s3 of the Protection from Harassment Act and also enforcement action under s4 of that Act and s129 of the Communications Act via OFCOM.

Please do not phone concerning this matter. If you need to communicate with me, write to the above address. The only correspondence I am prepared to entertain is a confirmation that Barclays are going to cease this behaviour. Any other correspondence will also be deemed to constitute part of the same campaign of harassment.

I recieved a letter confirming the removal of my number from their system and the usual bumph about resolving complaints internally and about the FOS. OK by me, but it's the police not the FOS if the calls restart.

I'm currently going through a Claim with Clydesdale aka Barclays partner finance. I wrote to ask for my total charges back (which amount to over £1000) and recieved a response today stating the £22.50 a time for late payment is fair and justified. I really want to reclaim this money back, and have received several phonecalls to my home which after reading this post could be deemed as harrassment.

Clydesdale removed my phone number from their system after I sent them the telephone harassment letter.

I find their attitude to the £22.50 charges to be rather dictatorial and would have thought that after being reprimanded they would have changed their tune. I got mine back because I owed them about the same so told them to get lost. It took a long time, but I think I have finally got rid of them.

Keep on battling. You will get there.

I claimed all the £22.50 charges back on behalf of my son - they are clearly penalties. I went through the whole process, including filing the claim in court and they paid up. They know they haven't got a leg to stand on - there is no way that an automated letter costs £22.50 - 35p, maybe - and it is clearly in response to a breach of contract.

Hi I'm brand new to this forum so please be gentle.

I am trying to find a valid phone number for Barclays Partner Finance which I understand is the same company as CFS. All the ones I have tried are unobtainable and even their web site appears down.

I bought an Apple computer on 6 months interest free credit just over 5 months ago and I want to pay it off before they add interest.

Looking on this forum CFS appears to be, lets say "customer unfriendly" and I don't want to get caught out by them. I have not received any reminder that the 6 months is getting close so that I can pay it off.

Any advise gratefully received.
