Afternoon all

At last, received what I thought was a court date. However, it's not. It reads…

"IT IS ORDERED THAT

The action be stayed until 1st December 2006 or until further Order on the basis that a test case is likely to be heard before a Higher Court within the next few months or so, the result of which is likely to reduce the need and/or amount of litigation in these types of cases."

To me this doesn't sound wonderful. Anyone had similar or know what's going on?

Yes. Is it just a Bristol thing?

Have they given you the right to appeal that decision?

If they have, then I recommend you read the "application for the removal of a stay" by Bankfodder

Adapt it for your own purposes and sent it in to the Court

I would definitely appeal. It's all very well them staying the cases but they have still to get Barclays in through the Higher Court doors. If they keep settling before the court date, then the possibility of that happening is remote for the forseeable future.
