barclays court action

Hi All
I've got to the stage where barclays made a third offer of half of what they owe me. The latest offer being less than the previous one.They called last night to ask if i'll except it and when I refused they said it was none negotiable so, I've paid the £80 to the claims online folks and am holding my breath. I'm none too clever on the computer so it took me five hours and six attempts to get it take my claim.

I was really getting frustrated and irate and the result was my letter kept changing until I let my feelings out and did some slagging off, result, I forgot to claim for my interest back! I could have put it right but I was too wound up, so I let it go. Anyway, will keep you posted on the result. On the bright side, I'm now able to help others that I've passed this on to so they don't let their heart rule their heads and make the same mistake as I did. Good Luck to you all.

Can someone tell me what happens next?
I've checked my claim on money claim on line and it says I can't continue the claim online because Barclays have filed a defence, I'm scared now. and seriously wishing I hadn't started this now. I never claimed my interest and I guess it's too late now to try,also, I haven't got the date of my first letter to them. but I'd like to know if I have to cough up even more money now? my other O/h will go mad as he told me to take the first offer and run.I'm hyperventilating now. Any advice will be gratefully recieved.

Hi Angie,

I am in a similar position, i am helping a sister but the nerves are immense... I am reading all the time and I think I am right in saying that you cannot carry on with online claim due to a defence being filed....this is because when a defence is filed the case is then transferred to your local court... I think that is right but if someone knows I am wrong then please let us know. Read the FAQ's Angie and all the information BF and others have posted on the court procedures in Bank Templates...but dont panic. Know you are in the right, then just make sure you get to grips with what may or can happen with your case..Read, read, read... you have to be prepared for this as it is not easy and certainly racks the nerves but it is not the legal basis that is at stake really, it is taking on such big institutions on your own. About other fees, I know there is another fee of about £100 I think related to completing an allocation questionnaire but again this can be claimed back from the bank anyway.

Hopefully someone a bit more confident will come along and help you angie and good luck..

Thanks Goldiea. I proper stressed out when I saw it. I've told so many people to claim their money back too, but, they are all way behind me and constantly ask have I got my money back yet. I hate giving them news like this.The jargon sometimes looks like double dutch to me especially when i stress. fingers crossed we both come out winners.

Keep at it Angie. Unfortunately it is a long and drawn out process but providing you follow the guidelines laid out on this site you will be fine. It just takes a lot of patience!

As regards further fees, if your claim is for less than £1500 then I think I am right in saying the Allocation Questionnaire fee is not applicable. If the claim is for more than £1500 then there is a fee of £100 but as goldie said you are able to claim this back too.

I received a letter from Barclays saying they disagreed with what I was saying, I have done my Particulars of claim and also my N1 form - is this all I ahve to take to court? And pay thr £100? Do I get the money back? even if Barclays dont pay up?

Sorry, you can't add to your claim at the AQ stage. The AQ is not about your claim as such, merely about what the court is required to do to accomodate the hearing.

Your only options are to pay an extra fee to amend your claim, or to withdraw then to resubmit your claim (either of which would delay your case) or of course, as you say, forget the interest.

Don't worry about what Barclays say - they're always disagreeable.

It sounds like you're using the paper version of the claim form. The "Particulars of claim" goes on the back of the N1 form. You need three copies of the form (one for the court file, one for the court to send to the defendant, and your own copy) with your final schedule of charges attached to each. Take these, together with the fee, to the court. The court fee is included in the box on the front of the N1 form and is recoverable from Barclays (not the court) WHEN (not if) they either lose or capitulate.

Oh oh! I have just seen this post and I realise I have only sent the form back that they sent me to fill in. No doubt, it will come winging it's way back again now. I started my claim online. but, when it came to being able to check my claim particulars, the adobe reader wouldn't work and has actually naffed the computers ability to read a lot of other adobe documents too. The same thing has happened to my sister-in-laws computer too. So, I haven't even been able to check what I wrote on the claim. Thanks for all your help. All I can do now is wait.

We've got a court date! 30th Oct. Didn't expect it to be so soon. O/H went white and gulped cos it's his bank account and as I've done the all the reading up on this brill site, and sent off of all paperwork he's panicking and says it's his luck to be the first proper court case.I laughed like hell, till I realised he's gone and lost the first letter off bank offering half the money. Anyway, I'll keep you posted.

Hi Everybody.
Good news. We've won! Court date was Monday 30th Oct. O/H got a letter this morning offering sum asked for minus interest. I told him to ask for the interest when he got the expected phone call. He got the call this morning and he just took the offer. I could have killed him

It would have meant an extra £150. He's also signed the secrecy form and sent it off to them. Little -turn -coat.Well I'm not him and I'm squealing

That'll teach him to let me do all the work so he can nip in at the end and take the glory. Only joking. I'm WELL happy today and ever so grateful to this great site cos without it we wouldn't be seeing a penny , never mind £890. Donation of 6% on it's way once money hits the bank, (would appreciate someone telling me what 6% would be) which according to Barclays, should be today. Thanks to all for supporting me and whatever you do, don't give up. You'll win too!
