Question I gave them 40 days...

I was introduced to this forum by a friend who was succesful in having his money returned. I however am struggling at the first hurdle! I have sent the initial letter asking for the exact amount of penalty charges to my account, however 40 days has passed and no reply....

Could someone please let me know what the best course of action would be from here on in.

Thank you.

Can you clarify...

Did you send your request recorded delivery?
Did you get a response?
Did you send payment and, if so, was it cashed?

How much would the payment be? I was under the impression that they would let me know if they required payment as this varies between banks... I have now sent it via recorded delivery and asked for a response within 14 days...

The payment is usually £10. I think some have not been charging (I didn't send a cheque with mine). Good luck

My request went over the 40 days, I called them on the 41st day and lodged a complaint. I got a letter today saying I should receive them in the post soon. You should try calling them, seems to have worked for me...

I have spoken to Barclays and they assure me that I should now have the information sent to me within 14 days!

I believe the next step to take is to send in another letter asking for the details of the individual costs (How they incurred £30-£50 worth of costs themselves) for each charge. Is this right or am I jumping the gun?

Thanks for your help!

FWIW

Yo uneed to follow a set procedure to ensure that you have the best chance of getting the data and your moeny back.

You should send the S.A.R - (Subject Access Request) and incude the tenner, thats the max they can charge. the SAr sets out what you want formally, if you havent included the same info in your letters then they are worthless and the bank can ignore them and your request.

Giving them 14 days may be ok assuming your orignal approach was ok, if not then i suspect the best course of action is to go back to the start, do not pass go and do not collect 200 pounds!

If you havent done so already, try reading the faqs there is a step by step guide in there which sets out the best procuedre.

Finally, dont rely on what the bank says it will do, they are not your freinds, you may end up in court suing them. Do things legally then if you do end up in court you have the best chance of getting your moeny back.

HTH

Glenn

Ps it is true that some banks are not charging, this is at thier discretion, if you dont send the payment they dont have to process your S.A.R - (Subject Access Request). If you do and they dont cash it thats thier problem. If youve offered then you have compied with what the courts would expect you to do.
