Default Consequences of accepting partial payment.

I am currently at the point of going to the small claims court having gone through all the other steps.

Barclaycard have paid into my barcalycard account a quarter of the amount I have requested from them. This amount appears to cover any charge in excess of £12 that they have charged me. It does not take into account any amount of interestautolinker.com autolinking image.

I am confused about filling in my form for small claims. I will be doing so in a Northern Ireland County Courthouse and it is relatively simple - you fill in the amount you are claiming (charges without interest) and then you also fill in the interest on the amount you are claiming.

Do I enter the amount of charges minus the refund but enter the original interest calculated from the full amount of charges?

Or do I still request the full amount and agree to subtract the refunded charges afterwards?

Also does the date I have been refunded affect interest calculation?

Perhaps barclaycard is throwing a spanner in the calculator?

Anyone else see my problem?

I'm in the same boat too but I'm in England. I'm really stumped now. I don't know what to put in the POC and I'm worried I'll mess up the court case by putting down the wrong thing.

A very good point...I hadn't thought of that! I simply amended the charges on my spreadsheet but sounds as though I've done myself out of interest because it reduced the interest too but you should be entitled to the full amount of interest!? mmmm???

Can't answer it myself but hopefully some clever person will be along.

Hi Guys,

from an honesty, higher ground point of view, the refund should be added to the spreadsheet. the interestautolinker.com autolinking image it takes off is only represntative of the refund issue, much the same way as when the bank chargesautolinker.com autolinking image you £38 and then refunds it the same day, you will see the charge gaining interest and the refund removing the interest so the overell charge stays at zero.
