Barclaycard have changed my direct debit date numerous times over the past 3 years, claiming the charges because of this back from the Halifax, so only fair Barclaycard get their turn too.

Received letter back from Barclaycard this week, telling me that all statements prior to June 2004 are kept on microfilm and take longer to search and reproduce, they state "a reply is likely within the next 6 weeks or so" !!

Looks as if I'll be issuing a second claim against them when the other statements finally arrive.

I got that same letter - does anyone have an email address or contact at the desk that produces the statements in Northampton?

I'd like to chase them up on this...... as from what I've seen it's not only a bltant delaying tactic but they actually never get back to you with the statements....

Have you sent the LBA for non compliance of data protection act. That should give them some encouragement. Theres a template in the library

thanks for that - I ddn't realise a "non-compliance" one existed.

in my case all my charges are "top heavy" i.e. I got loads of them at the strat of the 6 year period but almost none at all towards the end - hence i'm so keen to get my hands on those statements, as being with all of them at the start I know that the effects of counpound/contractual interest will really make the claim "worth it".....

it's just i would far far prefer to have the statements and issue rather than issue a N1 court claim without - as the statements are valuable court evidence of the penalities incurred. I know it's possible to take a claim through courts on the grounds of estmatied amounts - but I wouldn't feel so comfortable with that...... I guess I'm in a bit of a fix with them over the statements. I knew the credit cards were/ are pretty bad defedents.....

Atlantic, you're right not to claim until you get the info. I have found LloydsTSB have been the most difficult to deal with. They ignore everything, even my court claim.

It really would be better if you could wait until you have all the info and file 1 calim. It will save you time in the long run, my statements took around 65 days in total. You can still send the prelim and LBA letters with the charges you have proof of now and send updated schedules to barclaycard. You can keep adding charges untill you file in court.

As an after thought thats what I was going to do. I've sent a prelim letter with an added paragraph that the amount stated is only part of the charges due to Barclaycards failure to supply a full set of requested statements and that an undated schedule will be sent once they have provided the outstanding statements.

i just want everything to be as near perfect as possible with my claim....

the way i see it is that these companies (banks/ credit cards etc) are all about numbers (in whatever form: loans, accounts, etc) and I just want to make sure i get my numbers "right" before I go near them - as I know for a fact that if theres anything amiss they'll pick up on it for sure - as it's what they do all day long for a living......

also it'll help big time when it comes to court.... as I know credit cards don't settle "easily" for claims with contractual (compound) interest......

Finally received outstanding statements from Barclaycard, only 2 extra charges to be added but £40 is better in my pocket than theirs.

So finally prelim letter sent today.

OK, well after reading other threads and various stickys I'm now not sure on how to reply to their offer. None of the letter templates in the 'Rejecting Offers' section seem to fit, I just don't want to send off a LBA and if/when it gets to court it go against me for appearing to keen to litigate.

Advice anyone?

Dogspods.....

I'm in same position - in my case I sent 2 LBA's and they've come in with an offer (oh and incidentally an immediate credit to my defunct account without my prior approval) for £96.

I am just going to continue with course of action as normal and have already written back rejecting their poultry offer......

I remember from other threads in other credit card forums that this is just a "fob off" delaying tactic....... so simply stick to your deadlines and carry on as normal......

You can send the rejection letter when ever you are ready.

Keep to your time scales for the lba.

Most people get the offers and a lot have it put into the accounts, if this does happen you can either accept is as part payment or ask them to remove it.

Received a reply to my rejection letter basically ignoring it completely and stating they were not going to enter into any further dialogue with me, also attaching a copy of their Final Offer letter?!
