Wink Apples Vs Barclaycard - What next?

Hi new to this and would really appreciate your thoughs on what I do next: I have read the stuff on the site - great advice - but I read too
late to avoid this situation:

In June last year, I submitted a request to Barclaycard for a refund of my charges. I did not have statements available at that time and

so I estimated the refund amount. Barclaycard refunded me a fraction of my estimated amount. I did not take any further action until February of this year when I requested my statements. I have sinec received my statements and was shocked at the amount that had been charged.

I then sent an LBA to Barclaycard, requesting the full amount back. I'm not sure that I have done the right thing as I sent an LBA, rather than another request.

I have received a reply from Barclaycard, stating that the original refund to me still stands and they will not refund the full charges. I have a couple of questions:

i. Will the time delay between me initial requesting an estimated amount back in June 2006 and then submitting an LBA in April 2007 weaken my claim in any way?

ii. Does it matter that I submitted an LBA in April, without first submitting
an initial request for the cash back?


iii. Do I now send them a "Final" LBA asking them to re-consider or do I go straigh to court stage after the time has elapsed?

Hi Apples, is everybody having a night off or what, oh well it is Bank Holiday lol. Don't think it matters you have done things slightly the wrong way around and certainly doesn't matter about the time delay, we have done this ourselves since my OH and I couldn't afford to take Barclaycard to court after they made a partial refund in October until Feb this year. Raise the case online,plenty of information on the site and fill in the form as per instructions! Our case with Barclaycard is at the end of June so burning the midnight oil getting the case ready!
