Default Ristardoss v Barclaycard

Hi all,

Have two claims on the go at the moment.

Barclays: Going for £924.17 which includes the interest.The Bank has written to me and advised they are looking into it and that I should hear from them in six weeks. I've decided to ignore this and have just sent the second letter using the templetes kindly done by Martin.

Barclaycard: Now this one seems a bit more bother. Sent Subject Access Request on 27th Feb 07. I received a letter today with the last two years statements. The letter stated my previous statements are on microfilm and that they will be taking a further six weeks (perhaps). I spoke to a young lady today and she basically said that the bank did not agree they had to send my details but were doing as a gesture of goodwill. However I do have a feeling that this is just a delaying tactic. I've looked at other threads and get the impression that I should just ignore this letter and proceed.

Any advice on what to do next?

It does seem like delaying tactics. Pathetic, really.

Stick to your timescale, and move things on.

The microfiche issue is irrelevant - Data Protection Act says 40 days from date of request.

In fact the Data Protection Act states that the information requested shall be supplied as soon as is reasonable, and no later than 40 days.

Remind them of this.

Ha Ha! !

Love the thready title - it made me want to look in!!

I waited over the allotted time too. I think I waited an additional 2 weeks & was just about to file with court when they arrived.

The only thing you must remember is that you must be seen (by the judge) to give them every opportunity to deliver the goods. That means not just jumping in with court.

In a weeks time when its d-day, call them again, write to them again & then if still no joy then I would file.

Of course its your call & you wouldnt be wrong by filing - they're crafty bleepers!

Hi,

Well a couple of calls made today.
Barclays have stated they may have received my second letter but it has not been logged. I was advised that this does not mean it was not received just that they will not be responding to it. The young lady went on to state they are allowed eight weeks to resolve any complaint and therefore are allowed another four weeks.


Barclaycard also advised they have no record of the letter I sent regarding statements. They reiterated that they are allowed six weeks to get this info.
Whilst there I increased my credit limit. Don't know why just thought it would be funny.

Anyway I'm thinking of waiting another week and then pressing on with the next steps.

Any advice

Well I received a letter from Barclays offering £560 as a full settlement. Is there a letter template that I can send stating thanks but no thanks?

Still no word from Barclaycard.

Spoke to Barclays to advise I would not be accepting there offer. Young man told me to be aware as this would be their final offer.

Still no word from Barclaycard. Was looking to make a complaint on the Information Commissioners Office website. However it asks for the date my postal order was cashed but I have no idea.

Does anyone know if this is desperatly needed?

well I seem to have taken my eye off the ball abit.

Barclaycard have finally sent the statements through so will have to work through them.

Re Barclays. I must admit I was getting a bit worried with all thats gone on recently. I have actually phoned them and they sent their offer of £560 through once again. However I just can't bring myself to accept.

Can anyone give me the next step and a much needed kick in the arse
