Smile Me v Barclaycard

I rushed to send off first letter asking for my charges back but then realised I had sent the wrong letter. So started again with the request for the charges back. Got a reply theis morning normal stuff ... but did have a paragraph ......

"Following the recent announcement by the Office of Fair Trading (OFT), Barclaycard, in conjunction with Barclays Bank PLC and other Credit Card companies are currently reviewing this announcement and all customers will be notified of any changes as soon as possible"

Does this actually mean they are trying to operate a cartel? Working out ways to get out of the mess they have got themselves in?

No doubt the law will be changed at sometime to allow them to make this charges because they are powerful enough to lobby MPs and how many MPs sit on the boards of these banks?

The LBA will be going off today which gives them only 14 days, of which 9 are working days!!

Got Letter from Barclaycard this morning offering me £112 of a total of £728 of which £288 was the interest. I had gone through all the statements and added it up to £440 but he stated that they have only charged me £400. Interesting that they seem to have this information to hand despite them claiming that all statements prior to May 2004 have been microfiched!! So can a Data Protection Act just request the amount a person has been charged?
Done the request for repayment and LBA and the moneyclaim can now go in but do I write back rejecting this offer first or just continue.

I would ask them to prove to you that they have only charged you what they think. In order to do so I suspect they will have to give you all the print offs from their "system" in which case they can retrieve? Surely?

Finally put the Moneyclaim in against Barclaycard and checked my figures and they were as per the letter from Barclaycard, so at least I know it is the right amount I am claiming back now plus the interest and the 8% totaling over £600. I am not registering the claim no etc on the site because I believe Barclays are stopping members from posting their successes against them and they must be doing a Tomlin Order to do this. As I cant be identified from what I have put on the site so far I am hoping I cant still report my victory.

They put in that they wished to defend right on the 14th day, surprise surprise!!! Then got the defence on Saturday with two weeks still to run. it is now in London and the famour Keith Jeremiah dealing with it. So his department must be dealing with all claims against the Barclays group.
One thing that appears to be strange is the fact that they have refunded me the difference between £12 and £20 on all their charges and credited this to my Barclaycard account even though I had not accepted it. No mention of this in their defence though. They have also said they have identified me and put the account number in but this is not my account number???
Now have to do the AQ and get that back before 2 August.
