Default Started my claim

I wrote to Barclaycard centre at the same time I wrote to Crapital One.

Cap1 have replied asking for a £10 cheque, which I have sent on.

Barclaycard has not even acknowledged receipt yet.

Is this common, and how long do I wait before poking the bear?

I estimate BC owe me around £400 in charges over 2 years on a £650 limit card.

I didn't - that doesn't excuse them not acknowledging within 5 days as required by the Banking Code.

They can't go 39 days then send a letter saying "where's our £10" - if I'd sent the tenner they would have paid it into my account!

Statements arrived on saturday 3/6

£250 prelim letter went out the same day.

they tried the Microfiche thing with me, but then my account was only opened in May 2004

RESULT: Had Barclaycard on the phone on Friday Evening.

Apparently, for less than £500 in charges claimed back, they don't argue, they just pay up just before the end of the LBA time...

Excuse me being thick, but do you mean they have said they will settle in full?

We were offered partial payment after our prelim, which we said no to and then sent the LBA. Just got another reply saying sod off and ours is only for £265....

Well, they had till post arrived today to sort it, and haven't, so I've now gone to court. Moneyclaim requested, and mods informed. It's now £356.11.

Barclaycard acknowledged my claim today, and paid me £88 yesterday "without admitting liability, and in line with the OFT reccomendation of £12."

I sent them "accepted as part settlement of my claim" and added "misrepresented" like Capital One...

They have till 3 July to defend - wonder how soon I'll see the balance now. I won't agree to closure or anonymity.

Can I ask what letter you used for barclaycard, they owe me £250 and a cheeky girl ont he phone said to me today, you might not get it back you know give us your money or we will refer it to the collection agency...grrrr

and now they write back agreeing to pay, but only if I agree to the judgement being set aside AND to keeping the matter confidential. I've said "fine, see you in court, and I'm amending my claim"

And they write back saying "we're sending you a cheque" - which is not acceptable, as a cheque is not cleared funds... So I'm issuing a warrant today

Nice one, I like your style!

I've submitted my claim about a week and half ago and they have said they will defend, judging by what has happened to you they don't, which I'm pleased about.

I'll sit and wait.

It's good to hear you not taking any BS from them, is so refreshing to hear all these people taking some of the control back off the finance industry at long last!

Actually, they do defend, but in may case faioled to do so in time, and as I was on the ball, I got my default judgement before they filed their defence - which they still haven't served.

They've apparently sent a cheque and want me to notify the court of settlement on receipt... They are so arrogant, they think that with a judgement in my hand, they can still set terms!
