Hello.

This will be my 3rd out of 5 Claims i will be undertaking.

Heres what i have done to this point.

1. Completed a Partial Settlement in JAN 07 (Partial Settlement on Credit File)

2. Sent Subject Access Request

3. Received Statements from JUN 04 - Present.


(Cover letter States that Statements before this period are stored on Microfilm.... This is likely to be within the next 6 Weeks)
Q. Should i respond to the Microfilm Setback, or let the timer run out?
4. Compiled Spreadsheets with the Statements from JUN 04 - Present.
Q. Statements are Computer Printouts, when compiling the Spreadsheets, do i:
(a.) Use the Closing Balance or the Present Balance of that month for the month in Question?
(b.) I have only input "Standard Balance Interest" but on a few Statements there is "Cash Balance Interest" aswell as the "Standard Balance Interest". Do i ignore the Cash Interest Figure?
(c) Im not sure what rate i put for the Interest % as this info is not shown on the printouts. the Barclaycard website is no help either. any advice?
(EDIT) Logged in to Online Services got the following info, but still am unsure which to use on the Spreadsheets.
Interest rates Purchase Annual Rate 19.90% Cash Annual Rate 27.90%
5. ***Present*** Awaiting Pre JUN 04 Statements. Tick Tock...

Hmmm. only Received my Statments from 2004 Onwards, got the blah blah letter bout microfilm. so sent them a letter stating that my Deadline still stands. they only have 2 days left (Deadline 31/03/07)

what do i do if they dont send me these statements by then? move on to LBA!? but i wont know how much they owe cos i dont have all statements!?

Also as my Account has been Closed due to a Short Settlement in Dec, will this affect my claim at all?

I called Barclaycard with 2 days to go and told them they were breaking the Data Protection Act if they did not send all my statements immediately. Assuming you requested them under the Data Protection Act, I think this is true. The microfilm excuse is nonsense, tell them so. Beware that they will almost certainly deny responsibility/try and fob you off with excuses so stick to your guns. Might also be an idea to follow up by letter so that you have a paper trail.

Ok, i now have to go to court but i dont know what to do, as they have not complied with the 40 days and neither the extra 7 days. what am i claiming, because i dont have a figure to claim cos i dont have the data. confusing!? ....
