Default Roadrunner's OH v Barclaycard

Sent off SARN on 15th January for OH's credit card account.

Received a reply from them dated 6th February, stating that copies of the statements had been ordered for him, and he would receive them within the 40 day legal time scale

However, this morning he's received another letter stating that there is a delay due to the same "identical" requests , and that they have informed the Information Commisssioner's Office of the delay, they apologise and assure us we will receive them asap ...

Has anyone else had this, any ideas ???
I'm presuming I have to wait, or do I just go ahead and report them to the Information Commissioner for non compliance anyway ????

Non compliance letter sent 23rd November 2006

Preliminary request for repayment sent 11th Dec 06

Reply from the Halifax stating that they're investigating my concerns!!!.... Rec 15th Dec 06

LBA sent 30th December 2006

Offer from Halifax of £814.00 - 5th January 2007

Rejection of Settlement Offer - 6th January 2007

Papers filed at Court - 29th January 2007

Settled in Full, 16th March, 2007

They just made god knows how many people redundant in Manchester now they're saying they are inundated with requests????

You don't have to wait, the 40 days is a statutory requirement. You can complain to the Information Commissioners Office and/or send one of the Data Protection Act non-compliance letters in the template library.
