Angry Barclaycard has taken money from my current account without warning!

Yesterday I just realised that £315 was missing from my account, leaving me with...NO money for the next 4 weeks!:o
I am already low on cash thanks to fraud on my barclays current account last month,
and when I called them up in panic last night to ask where the hell my money had gone to, they told me I had made a debit to barclaycard!
I have an outstanding debt on my barclaycard, I havent used it or paid anything for about a year or so, mainly because they ****ed me off by sending me THREE statements in one week, all with THREE different balances on them, and when I was made redundant without warning and had to wait 3 months for the two month pay work owed me, and somehow barclays card managed to say that my payment protection cover didn't cover it..!!!
I stayed on the line for an HOUR, spoke to EIGHT different people, who all kept passing me on to someone else, and then I was told that the department I needed, was closed.

Anyway, I'm left with 50 quid to last me 4 weeks, and it is my birthday tomorrow, it wouldn't surprise me if they did it the day before my birthday on purpose..!

So barclaycard has just gone and TAKEN over 300 quid out of my current account, with no warning whatsoever.
There is NOTHING in my credit agreement with them that says that they are entitled to do so, so i cannot possibly see how this can be legal.
Also, the debt collections agency (which I now have been told probably is barclaycard's inhouse agency, westcott), has sent me letters saying THEY are now dealing with the debt, so I cannot see how Barclaycard can suddenly reverse this and deal with it themselves now..!

I desperately need some advice on what to do and my rights, before I call them up (If I can get a minute away from my desk..I'm not finished at work until 6 and they close at 5...and judging by last nights mess, it'll probably take me another hour to get through to the right person!)





Normal debits that used to come straight out of my account, just normal electron debits, is taking several days to come out of my account all of a sudden, leaving me with no way to know exactly how much money I actually have in my account, I dont understand why I pay for barclays to manage my money, when they seem to keep me more disorganised than I would be if I carried all my money in cash!
I suddenly have hunbdreds of pounds coming out of my account, in transactions that I have made a week before.!! It is impossible for me to keep track of my money and transactions when they keep delaying all the transactions!
Sometimes I am almost sure that money has gone missingg, but its impossible to check, because the transactions are all delayed and so, dated with another date than I originally made them.
Especially in the light of fraud committed on my account last month, I am getting quite concerned about it, but barclays just tell me that 'well, thats how it is'..no explanation why the same debits used to come straight out of my account up until a couple of months ago..!
I am desperately trying to switch banks, but now, thanks to barclaycard that has given me a default, I can't!
I like to call them barclays w*nk..

I am not certain of all the details but there is a sticky somewhere which talks about something called the 'right of appropriation'.

As I understand it a bank cannot take all your moeny to pay its charges and leave you with notihng to live on, now it may or may not be relevant but i would look at that if i were you.

Seconldy its difficult to know where to start beause you situation sounds quite complex with respect to your debts and who is involved. Perhaps you cuold briefly set out whats what and then perhaps people can help.

Sorry about the long post, it's just thatbarclays are getting on my nerve,
but to cut a long story short,
I owe barclay card about £1000, but it will be less as soon as I make a claim for unfair charges, (I have already got my charges paid back on my bank account, but not on the barclaycard).

I haven't had any letters from the collections agency in along while, and none at all from barclaycard, as the agency sent me a letter saying they are dealing with it from now on.

They took £315 out yesterday, leaving me with £200, £150 will come out of my account for Direct debits (my bills) in the next couple of days, which, will leave me with £50 for the next 4 weeks. That is, if barclays doesn't have any more delayed transactions that they will take out, like they keep doing.

I don't see how it can be legal, when there is no mention in the credit agreement (I have just read through all the small print) of their entitlement to take such action..!

Oh and thanks for your help so far

i believe that most accounts full T&C gives the bank the right to offset money from one account to pay debts owed on another account generally.

if may be explained in terms of offsetting if that helps.

Regardless of this is if you dont have in place a repayment plan and havent had any communication with them this is the kind of thing they are apt to do.

As i said have a look at the rights of appropriation thread and see if that offers you any help.
