You need to give them a nudge and inform them you will report them to the Information Commissioner if they dont comply.

Ok, they say they have no record of having received it.

I'll send a new one recorded delivery.

Looks like the bloke on the phone was wrong and they did get my letter.

Package arrived today, dated 9 March - 2 months since the Subject Access Request was sent.

It says they don't believe microfilm is a "relevant filing system" under the terms of the data protection act, but as a gesture of goodwill, they're supplying all the statements going back to 2001.


My charges total £315, so I'll send a prelim letter off for that.


However, here's something:

I cancelled my PPI in Aug 2005 as that's when I first realised it was optional.

The cost over the years preceeding that totals many hundreds.

Should I send another letter asking for that back, suggesting it was mis-sold as I was young and naive, didn't realise it was optional etc etc?

Very swift response to the prelim letter.

They don't agree with my legal analysis, but will credit £123 to me, as the difference between my charges and the current £12 charge.



Should I pursue further? I would with a current account but is it the same for credit card?

It's the same, pursue it all the way but they normally only settle just before court.

I'll send a LBA, saying I'll take the offer as part payment but restating my claim for the rest and giving them 14 days or court action.

I was sidetracked for a few days by starting a new job, but my letter has now been posted.
