Default Anyone else had a standard reply on Subject Access Request to say will be delayed

Letter received this morning that says

Further to your request for copy statements, we are writing to inform you that the 40 day legal time limit for supplying this information is about the expire. (actually the Subject Access Request was sent on 9 April so by our reckoning it's already a little over 40 days!)
The reason for the delay in our providing this information is the very large number of identical requests that we have received, all of which we are obliged to respond to within the same timescale.
We have made the Information Commissioner's Office aware of the volume challenges we face and we are writing to you in these terms. We are sorry for the delay but assure you that we will let you have your statements as soon as we can.
We regret that we are not able to enter into correspondence with you about this issue.
Incidentally we had something similar in response to a request under S78 Consumer Credit Act 1974. Looks like Barclaycard are in trouble!

Yes, exactly the same - they can't cope - keep the pressure up on them and they will cave though, both the Subject Access Request and your money ....

I have written a reply to their letter in my post if you want to see if it is relevant to your case.

I will be filing my N1 at Northampton County Court on Friday for their non compliance.

Yeah they sent me the same rubbish. But then again I dont care about their problems, they dont seem to care about mine! So will be sending Mr Whalley a reminder next week

Well if they hadn't spent so long trying to figure out ways to stall and bluff, they wouldn't be in this mess! Tough!
Can just see the next time they request a payment from a customer, the customer replying 'well, I've had a lot of requests for money this month, so I'll get back to you as soon as possible'...anyone tried that yet?
