Default Barclay Card Help needed

Hi All,
Barclay card have failed to supply all my statements, from the statement they have supplied their owe me £370. But I believe that the missing statements would be worth £3000.
Do I send a Schedule of charges estimating the charges as BC have failed to supply statements ?

might i surgest sending another letter or ring them first and asking where you statements are
i have seen some referance to this problem in the bank forum .i am sure thats what was surgested there may also be referances to this in the bank libary hope this helped

I have sent a LBA but didn't receive any response from BC.
Can I submit a claim of the estimate charges to money claim or will the court throw my case out due to me not having proof ?

Have you tried to get the information with something like this:

LETTER BEFORE ACTION
Section 7 – Data Protection Act 1998

Dear Sir/Madam

ACCOUNT NUMBER: xxxxxxxxx



I am very disappointed that you have failed to comply with my Data Protection Act Subject Access Request dated 23rd December 2006.

The time for compliance with my request has now expired. If you do not comply fully with my Subject Access Request within 7 days, I will immediately inform the Information Commissioners Office, as well as issue a summons with the county court enforcing your compliance.

Furthermore I will seek damages for the same.

Yopu can submit a claim based on estimates, but better chasing down the Subject Access Request and having the correct number, if you can wait a coupl eof extra weeks - they may well settle at LBA stage anyway so it the long run it may be quicker doing what Nevos says.

You can also send his letter to Adrian Whalley using adrian.whalley@barclaycar d.co.uk

note the space inserted bwteen the r and d of the email address - you need to take that space out - its to prevent spam

Did this one yesterday after getting a silly letter from MBNA:

Dear Ms Claridge,

I am very disappointed that you have failed to comply with my Data Protection Act Subject Access Request dated 27 December 2006 requesting a full disclosure including any deed of assignment. (copy attached).

You may know that a district Judge recently ordered the Royal Bank of Scotland as follows:-

The Royal Bank of Scotland now has until January 2007 to comply with the users subject access request. The District Judge has indicated that if the Bank has not complied with the order by that time that he may make an order for imprisonment of the RBS Data controller.

On expiration of my request and, if you do not comply fully with my Subject Access Request within the statutory time, I will immediately inform the Information Commissioners Office, as well as issue a summons with the county court enforcing your compliance.

Furthermore I will seek damages for the same.
