BC charges can any one help , do you have to pay the exessive charges they slap on your account ie before a certain date it was £25 now £12 can all these charges be challenged , because they are automated and not done manually [late payment charges] or any charge why should you have to pay silly amounts

Hi Charley,

Any penalty charge made to your a/c in the last 6 years can be reclaimed in full.

Whether you were charged the old higher amounts, or the lower and more recent £12 charges, you can reclaim the whole amount.

If you just claim back the charges, they'll be repaid quickly in most cases.

If you claim interest at the contractual rate, you'll have to file your claim at court and BC will fight you all the way. If you get your claim right, they should negotiate a settlement just before your court date. The amount you can claim in higher interest can be significant.

They normally manage to reply to Subject Access Request's.

If the don't, you send them a reminder (from the bank template section) about their failure to comply with your request in accordance with the Data Protection Act.

hi many thanks , have started a new thread , a question , ref credit card charges i add the interest at the point of the offence, and i can add a further stat 8% on the total at the end , or at the time of the offence ha lol and ref the ppi credit cards charge is this the same .

Have they supplied your Credit Agreement - that's a rarity.

They will only supply data going back 6 years. If you want older stuff, you will have to challenge them, threatening court action for their non-compliance using the DP Act.

Hi Charley,

Problem is that, whilst you say the a/c is In Dispute, they say it is not. They will therefore also say they're entitled to chase the a/c, issue a DN, etc.

Have you used the data received so far to fill in a site spreadsheet to make your SOC. You could send this to BC with a Prelim Reclaim letter, and amend the amount claimed if/when you receive any older statements.

This will formally put the a/c in dispute in a way which BC can't argue.
