They'll probably send you a load of rubbish by way of reply saying the 1983 SI allows them to omit anything they please based on their favourite legal case, Rankine vs Amex.

Letter dated 8 Jan, received 12 Jan, from Calder Financial (1st time ever from them) saying OH has failed to contact them. 7 days to pay full balance or else, blah blah blah

It's reported elsewhere on the forum that Calder financial are just Mercers/Barclaycard under another name.

If they are computer generated silent calls then a complaint to OFCOM is in order. There is a maximum £50,000 fine for companies that bombard consumers with numerous silent calls.

"Government has confirmed today that the maximum financial penalty that Ofcom can impose will be increased from £5,000 to £50,000 for each breach of the rules."

Trouble is, they were silent and numbers withheld, so how do I report them

Besides, I've already got more than enough recorded calls, with 'human beings' and their numbers and their manner of speaking recorded anyway and a stressful visit to the doctor today who has made a note of it

I am sure that OFCOM, either via BT or there own methods, are capable of tracing where a 'number withheld' originates from. Even through asking for the computer logs for calls from the organisation responsible to trace and calculate the number of calls dialled to an individual consumer.

You can state it is your reasonable belief that these calls originate from this lender and ask them to investigate as a matter of urgency due to the continual harassment being received. (Which is directly affecting your health.)

Trouble is, OFCOM are not interested in human beings calling but they are (should) take a dim view on the silent calls. I think it's well worth a try!

12 Mar 09 - Wrote to BC reminding them of original request for CCA on 14 Nov 08, also gross amount of calls, copied to Mercers/Calders.

18 Mar 09 - Reply received, CCA will be sent in separate post

27 Apr 09 - Undated Notice of Formal Demand for total with interest and charges included.

Hi AA,

If you haven't started on the CPR strategy, do so now. You'll get nowhere with the CCA route.

Have you read this - CPR Strategy - IMPORTANT SUCCESS for smt37

You can send the 1st letter now, then the 2nd. When the time is up on the 2nd, you should have an idea of how BC are playing it in smt37's case.

Still no sign of my CA which BC acknowledged on 18 March

2 letters from Debt Managers Ltd this week. 1st one was an URGENT FINAL DEMAND. 2nd one is headed Settlement Opportunity - we may be able to take advantage of a possible, without prejudice, reduction !!!

I shall bang off a CPR31.16 this weekend

I haven't gone CPR31.16 route yet, because sexy first name only girl phoned from DM this morning asking to speak to my OH, first name only Wouldn't speak to me so gave her some recorded cheek about going this his wife first before sexy first name only girl could speak to first name only OH

When she revealed where she was calling from I told her he didn't talk on the phone anyway because he's deaf so I promised her a written response to their letters today.

What I have sent is a letter to BC referring me to their letter in March promising me my CA in separate post which I still haven't received. Pointed out I had been harassed by Mercers, ScotCall, Calder Financial and now Debt Managers, since that time. Copied this letter in to sexy first name only girl
