Default Barclaycard keep giving me refunds

Hi guys,

I need some advice. About 4 weeks ago I wrote to barclaycard to claim £6k of charges and interest going back to 2005.

However, a week later I got a letter denying the charges, but offered £60 and was already on my card.

I then sent another letter to confirm that I would take it as part payment, but would still be pursuing the total amount.

Today, they credited my card with a further £205.

So obviously they are refusing to give me the full amount.

What should I do?

Hi Cruizer,

same thing happened to me, they paid money on prelim then cut my credit limit and then refunded more on the LBA and again cut my limit. I will be seeing them in court due to them not paying all the charges back or any interest, so if i was you carry on as normal and follow your timeline not theirs.

Regards

Hum could cutting back your credit limit both times be classed as retaliatory action

Oh barclays LOVE decreasing credit limits. Until last week I also had a Littlewoods card (barclays). My initial limit was £500 then over a year went down to £300 everytime I made a payment, I would then get my statement saying we've reduced your limit.

They've been doing the same on my barclaycard. To be honest with you I could'nt care less if they reduce my limit as I want this card closed too, but I want THEM to pay my balance with what they owe me.

Anyone else having problems with barclaycard?

they state in seperate letters, from the letter advising of the refund, that after reviwing your account we are lowering your credit limit to. they also throw in the " as a responsible lender" crap, 4 years with the same credit limit and then in the last10 months 3 reviews all with credit reductions, might seem strange

Well it makes a change from the previous 15 years of 'we have increased your credit limit' when you are only making the minimum payment and clearly cannot afford to take on more debt. That is called irresponsible lending and has put me where I am today However thanks to the hard work of people on this site I am so far winning I think

Okay, got a letter this morning, with regards to my LBA.

They said that they think their charges are fair, however, since August 2001 I have incurred £265 in charges. It says they have refunded this back to me on my card, however, refuse to pay interest.

It also says in big letters 'FINAL RESPONSE'.

What shall I do? I am scared if I take it to court, the judge will think barclays acted fairly by giving me back all my charges for the last 6 years?

If they have offered to pay ALL your charges back, you have to accept and you forego the interest.

If they offer less than you are claiming (I note you refer to £6K above), reject their offer, continue with you claim and file Form N1 14 days after the LBA.

Don't be scared about going to Court - if you do, it'll be to win.

Slick

PS Is that right in your 1st post - £6K in charges plus interest from 2005?

If your claim was for charges plus the interest you have paid on them then your entitled to continue with the claim.

What you cant do is claim the statutory 8% allowed by the court unless you have issued a claim..

It is a fairly simple process with a pen and calculator to work out how much interest youve paid on the charges and you will be surprised how much it comes to

Eg. a £20 charge will become £23.57 after a year at an interest rate of 1.4% per month
