Bailiffs and Cr@pital one.

Hiya,

I have copied this thread I posted in the Cr@pital one section of the credit card thread.

I'm in trouble with cap 1.

On the 15/4/2007 I had a CCJ against me at Northampton CC Wich I have to say I knew nothing about intill I got a rather nasty letter from my local court here saying that if I didnt pay £152.00 by the 24/4/2007 there would be bailiffs at my house ready to take goods away to the value of £520.00. I only had a £200 limit so the £320.00 is fees.

Anyway I quickly phoned the bailiffs at the local court and explained my situation. I cant affored to pay £152.00 straight out, so the nice man said I could pay £75.00 one week then 2 weeks later another £75.00

This is where i'm at now, been to court to pay 1 x £75.00 the next £75.00 is due Monday 14th May.

I just want to know if I can claim back the £320.00 well I dont mean claim back as in have the money in my bank, but to wipe the fees off my account and can I still do that even tho Ive had a ccj against me?

The answer is most certainly yes.

My specialality is in bailiff matters, you would be better putting this post in the bank fees section .

There is bound to be somebody there that can also advise you on whether you should apply to have the judgment set aside. You should certainly ask the question otherwise you have a CCJ against you for 6 years !!

Great stuff, I am clued up on all I need to know about claiming from cap1 now thanks to this site.

meanwhile I still pay the £75 to the courts as arranged?
