Angry barclays v me i am winning so far!!

well little late posting this but never mind.
Started my action against the big "B" in ernest back in jan 07 after humming and haring since may 2006 kept hearing martin lewis from "money saving expert . com" bangging on about it on many occastions with jeramy vine on his lunch time show 12-2 on BBC radio 2.

So in jan 07 followed a link from his site to this people at Bank action group and using there letter templates sent the first letter asking forthe total of over £ 1600.00 (the can i have my money back please). Been in business i keep all my bank records so did not have to go through that proces of paying to se them. 7 days later barclays replyed with sorry to hear , we are looking at it and will reply by 12/02/07 with are findings ( delaying tacktics or what).

On 31 jan they sent the , its with in are terms letter so not are fault BUT as a offer of good will we will pay £950.00 you have 8 weeks to except. (So its not there fault but have all this cash cause we are a nice bunch of people!!)

On 11/02 after giving it some thought i said stuff them i want my cash back all of it so went to i am taking you to court phase again using the template letter gave the 7 days to replyno reply was sent so on 1st march using the on line small claims service www.moneyclaim.gov.uk payed the fee and started court action, they where served on the 5 with a notice of issue which gave them 14 days to reply....barclays been crafty waited to the last day to day to acknowledge my claim so that gives them till the 2nd /4 to file a defence........hopeing i will drop it are they NO CHANCE...i will go all the way till the end...even if it means winning and sending in the baliffs...

Yes they are banking on some ruling next month by the govenment or some on to limit there blame to any thing over £12.00 but they will not win over me

Good on you, i am also following a similar route to yourself with the big 'B'.

As i am a little new to all of this what is the ruling the banks are awaiting, is it similar to the OFT recommended limit on credit card charges?

Would this essentially change the reclaiming process ... as people would no longer be able to claim all of there penalties back?!?

Forget the "ruling"....it's no such thing !!
It's just that the OFT may propose a reccomendation (after far too long sitting on the fence).
It will have no legal basis, and will not affect your basis in law for the actions you can take (only an act of parliament could do that). The general feeling is that they might come up with some figure that will be suggested as a cap on charges(a figure similar to the £12 reccomendation on Credit cards has been speculated at, but it will not be a legislation, nor mean that such a figure is a true lawfully worked out cost). In any case, it will not be retrospective.
