Default Notice Before Removal

Hope someone can help me please.

I have just received a Notice Before Removal letter from a baliff to do with outstanding Council Tax.

Unfortunatley I was not aware of my rights previously and set up a walking possesion. I was a few days late on 1 payment and now the baliff is saying that he will arrive tomorrow with a locksmith and police to gain entry.

I have contacted the council to see how much is outstanding and the baliff is requesting £140 more than what is owed. I asked if I could pay the council direct and the person I spoke to said as it was out with the Collection company I had to deal with them.

Can I just make payment to the council and then put the account with baliff in dispute as I try to accertain what fee's have been levied on to my account.

Any help today would be very muvh appreciated.

Having spoken to the council again I have been informed they will notify Phoenix Commercial Collections to say the payment has been made.

I contacted Phoenix to state that I am disputing the fee's and have been informed I still have to pay the outstanding amount and then dispute. Is this correct.

Bailiffs have to provide a complete breakdown of fees charged. If I were in your position, I'd ask them for a copy of their schedule of charges relating to this case, work out by how much they're trying to overcharge you, then pay the charges minus the overcharge. What can they do then?

It is with regret, that yes, the system is set up to pay and then fight back.

The fees are set for Council tax, so my suggestion is, that if you are going to pay, then by all means email our office and we will happily give you a breakdown of charges that should be correct.

One thing that is becoming more and more of an issue, is that Bailiffs collecting for council tax are charging £90 - £100 for their van fees or attendance, which can be disputed.

Funny to think, that a van hire for a day is £25! Unless they are turning up in a MAC or 18 wheeler truck, then the cost is unreasonable and disproportionate. It amazes me this charge and we continue to fight it, as you should not have to pay for their vehicle to get too and from work!

Hope this helps and if finding the money is an issue and you are struggling, don't pay it all as there are options!

Phoenix Commercial Collections
Hi all this is my first post and I am very aggrieved with my experiences with the above. I have been directed here from another Bailiff related forum and have realised that they have tried to scam quite a few of us.

For the last two years they have taken over my council tax account and I came to realise that they are not reducing my total owed but slapping more on top for no reason. For instance in January 2007 a baliff posted a letter through the door without knocking adding a fee of about £400 to an outstandng bill of £1174, I complained to the local authority who logged into Phoenix's computer and realised that they had been scamming me for months for unjustified fees and I had the letters to prove it.

Now I have been making payments of £100 per month since january to reduce the £1174 and have now received letters saying that I owe a total of £1014.00. No balliffs have been round, no information about additional charges. Ring them up they get rude and do not want to discuss charges , ring up the council and they tell me I have only paid £10 since January according to Phoenix computer.

They definitely got the money because they have confirmed several times.
It was only when I advised the council I would be contacting my MP that they stopped sticking up for Phoenix and decide that I have to show them proof that I had paid.

But what is happening to the thousands of other persons they are dealing with SOMETHING HAS GOT TO BE DONE.

Any suggestions.

I'm just in the proccess of dealing with my Bank Charges from Nationwide, as soon as this is complete I shall be fighting phoenix and getting a full breakdown.

Nicegirl - keep an eye on this post and I'll update with recovery of fees etc.
