Quite hard to believe they took all this and no offer was made to them by the manager, again i would have paid money to see this happen and im sure the press would have too.

they have taken nothing form the bank all they have done is levied goods, the bailiff will have said "OK you chat to head office and I'll levy as I have to levy or take goods today but if I levy I can give you a week or 2 to sort it out"

I thought bailiffs couldn't seize items required for work???

A bailiff can't seize a computer from an individual if it is need for work. Why can they do this to a bank?

That is probably what has happened raher than remove the goods and then send the op any details. they have jumped one step ahead and told the op what the future steps were going to be.

10/01/07, quote 'The bailiff has levied on goods belonging to the debtor. The bailiff will remove and sell the goods if the debtor does not pay. If the proceeds of the sale do not cover the costs of removal & sale you are liable for the shortfall. The bailiff has levied on 4 computers, 2 fax machines, cash register & contents'.
This is the standard County Court Bailiff response when a levy has taken place to the claimant. If he had taken goods he would have said so and when the sale would be taking place.

A computer is open to seizure yes......if you are talking about tools of trade that does not apply to a warrant served on an individual rather in the course of normal everyday business.
However if there is an alternative that could be used and it is visible for example a manual filing system then it can be taken. The only issues would be one of Data protection where data is stored on others.
Presumably that could become an issue.

this is bizarre ...

i think the bailiffs might have given the bank more than a chance they give to us 'normal' people.

and they should have seized enough goods to pay for the debt.

looks like they've done one over YOU!

I would pay £25 a ticket to be there if they actually do remove goods...during business hours...preferably Saturday lunchtime, ooh, around half twelve say?

I would just like to point out the levy and walking possession is essential, if this was not the case this forum would be full of posts that say "the bailiffs have taken everything i own", these rules apply to ever last jack of us to ensure the legal system works correctly.

There was a big article in the Daily Mail as well today, together with advice on how to claim back bank charges and a mention of Consumer Action Group. The more publicity the better - it'll encourage more people to stand up to the banks. What a great story!

Just picked up this story and also read of it in the Daily Mail today, Saturday 20th. It has reached the papers and I send hearty congratulations to Declan Purcell for having the perseverence to carry this through after being wronged. That's what is required. Sock it to them right between the eyes as deserved. Banks delight in bullying customers and the more they get of their own medicine, the more they will begin to realise that their days of abuse are rapidly drawing to an end. Job well done.
