Guest | Re: Baliff has taken banks computers....and cash register too !! they have taken nothing form the bank all they have done is levied goods, the bailiff will have said "OK you chat to head office and I'll levy as I have to levy or take goods today but if I levy I can give you a week or 2 to sort it out"

10/01/07, quote 'The bailiff has levied on goods belonging to the debtor. The bailiff will remove and sell the goods if the debtor does not pay. If the proceeds of the sale do not cover the costs of removal & sale you are liable for the shortfall. The bailiff has levied on 4 computers, 2 fax machines, cash register & contents'.
| This is the standard County Court Bailiff response when a levy has taken place to the claimant. If he had taken goods he would have said so and when the sale would be taking place. | |

| | Site Team | Re: Baliff has taken banks computers....and cash register too !! A computer is open to seizure yes......if you are talking about tools of trade that does not apply to a warrant served on an individual rather in the course of normal everyday business.
However if there is an alternative that could be used and it is visible for example a manual filing system then it can be taken. The only issues would be one of Data protection where data is stored on others.
Presumably that could become an issue.

looks like they've done one over YOU! | I would just like to point out the levy and walking possession is essential, if this was not the case this forum would be full of posts that say "the bailiffs have taken everything i own", these rules apply to ever last jack of us to ensure the legal system works correctly.
