Default Karnevil V Abbey Business - **SETTLED**

Hi,
I sent my Data Protection Act letter to abbey with a postal order for £10 - I assume this acts the same way as cash although I am a little worried that I will not know when they have cashed it to begin the 40 days or is the 40 days from when they sign for the recorded delivery letter ?

The letter was posted recorded delivery on 20th April.

Also...

Submitted my request for refund of charges (982) on my business account with abbey, also sent on 20th - I assume 14 days is from when they sign for this letter also ? I'm working on 5th May assuming they signed on Friday (the recorded delivery infos not showing on royal mail site yet) - to file with moneyclaim.

Thanks for your help.

Sound like you are on top of things.

You will probably get a letter along with 13/14 months worth of account information stating that the rest is archived on microfiche - if you do you need the letter at the top of the Abbey Forum.

Just reading Toni's thread - and have confused myself -- I thought the letter I sent to the bank to request my refund was the LBA - is this not the case ? Is there another letter I should send after the 14 days giving them another 14 days before I file with moneyclaim ? I thought I sent the request for refund then filed with moneyclaim if they didnt pay up within the 14 days......

Does that make sense.....

Update - received statements (all in seperate envelopes!) back to September 2005.for one of the personal accounts. Expect to receive microfiche letter in next couple of days !

No letter re LBA for business account - they have until May 5th.

Received more statements today - again 1 year - for the second personal account. I think these may be from my telephone call to request statement copies before I sent the Data Protection Act letter off - so they still have fair while to get the rest to me...

still no word on my LBA for my business account... 14 days - does that include the weekend and bank holiday do you think ?

They charge interest and fees during weekends and on bank holidays - so why should we suspend action on those days.

Opened parachute account at nationwide - and requested all dd change of details forms from all creditors - although many I will now be paying in cash at the PO.

still have to open a new business account - any recommendations ?

Thanks Alan - have indeed opened account with NatWest now - online - waiting for their confirmation forms to come through then will be starting process of moving payments in over to new A/c - and re setting up all my bill payments.

If I hear absolutely NOTHING from Abbey re my LBA do I just go ahead and enter my claim on the 6th May ? Most people seem to have had at least a sod off letter - still a few days left though.

re Data Protection Act request - my DPA request letter has not been delivered even though it was sent recorded delivery on 20th April. I'm now not sure if I used the right address; I sent to the PO Box 382 Prescot Street London E1 8RP - other people that have sent letters there seem to have got on okay. The post office told me that if it is not delivered or returned to me by the 10th May I can claim compensation for my 50p odd, and I can also put a trace on my postal order for the £10 DPA payment.

I will send another to the Abbey Data Compliance address given on another thread tomorrow so I don't lose too much time from it.

Was tempted just to do an unknown amount claim letter - I have statements from the last 14 months - apparently sent due to a telephone conversation I had with Abbey about the same time I sent the Data Protection Act request - So I could reasonably work out the average per month from this and multiply it by the six years, but I think the accounts have been run pretty well over the last year and not accrued too many charges - its before then we had the major problems - SO HAVE DECIDED NOT TO DO THAT !

Has anyone else had letters sent by recorded delivery to the PO Box address not delivered ?

Right - have today sent new Data Protection Act request for one personal account to address above and have sent prelim letter for second personal account as I more or less know the charges on it already.

Still havent heard back from ABBEY re LBA on business account - 3 days to go.

BBC news report this morning is fantastic - I hope you guys dont get too overworked ! - keeping an eye on your Donations thread - will be donating if and when I win some of these charges back........ I would never have the confidence to go through all this if you weren't here.
