| | Platinum Account Customer | Re: Abbey Data Protection Act Question Still worrying Moneyclaim seemed a bit too simple.
I used the suggested text but after I submitted it realised I had not put my account number anywhere on the form ? or any workings for the amounts requested ? Will this all come in the court allocation questionnaire bit if they defend ?
probably just stressing out for no reason.
I hope ! |

| | Platinum Account Customer | Re: Abbey Data Protection Act Question ah ha - on personal accounts I sent Data Protection Act letter on 20th of April and the Royal Mail are now confirming it was signed for by abbey on 21st April - so I am now taking my 40 days from then..... I have put a trace on the postal order I sent so I will know exactly when they cashed it. Once I have got my info I will start hassling them for return of my second DPA request and cheque. |

| | Platinum Account Customer | Re: Abbey Data Protection Act Question Just typing out my Letter Before Action for my first personal account which I am estimating the amount.
I have changed the wording in the amounts paragraph a little, to read; As I have requested information under the Data Protection Act and this has not been forthcoming, I calculate that you have taken £3240 over the past 6 years. This figure is based on a reasonable estimate based on charges unlawfully taken from my account from May 2005 to May 2006. Does this sound okay or is there more legal terminology I should use ?
Thanks for your help |

| | Platinum Account Customer | Re: Abbey Data Protection Act Question Just called abbey to ask for a couple of statements from early 2004, I need them for a seperate issue regarding a loan with another bank that I'm sure I paid off, and the indian call centre lady said yes no problem will be within 10 working days, charge £10 (I asked for 4 months of statements)....
So IF they turn up within 10 working days I think I will be wondering why on earth it takes so long to get my Data Protection Act requested statements through ! |

| | Platinum Account Customer | Re: Abbey Data Protection Act Question Received today printouts for both my personal accounts - but only for Feb & March 2005 - at the top they are labelled - Movements Enquiry.
I assume this is just movements on my account, not details of manual intervention ?
Do you think this is the first of a number of envelopes with my 6 years info ? |

| | Basic Account Customer | Re: Abbey Data Protection Act Question The movement prints are just the cashier print outs that is available to branch staff on the computer system. These could have been printed off in a matter of 5 mins and put in one evelope. If you look at the top you will probably see contract staff on the top also. I get the impression they are struggling abit
I'm getting mine exactly the same way, just wasting time I think.
Thinking of ringing them monday and asking them what they are playing at, as a shareholder they are wasting my money................they will probably put the charges up to cover the postage they are wasting!

| | Platinum Account Customer | Letter from abbey Solictors Abbey have acknowedged my claim dated 22nd May - which gives them 28 days to file a defence ?
Received a letter today from Piper Rudnick et al saying they are getting the defence ready. It also says I have provided no details as to how the sum has been calculated, should I send the solictors a copy of my spreadsheet ??? (the 8% workings excel file one) .
I filed online with moneyclaim and there wasn't enough space to include much info. I assumed this would come later in the court allocation bit.
by the by - weirdly they have signed in block capitals DLA PIPER rather than a signature of a real person (david cook has provided his email address) and there isn't a PP mark - surely a solictors would sign their letter correctly.
Any way could do with some advice what to do next.... Many thanks

| | Platinum Account Customer | Re: Abbey Data Protection Act Question Its okay - I found some info on dealing with this on another thread... by searching on Piper Rudnick ! Another claim - **WON**
so will send them a letter saying saying that their client had given me the information on my statements -and enclose a copy of my spreadsheet, and if their client was prepared to return the sum of £xx.xx plus interest, then I would be prepared to stop suing them.
(thanks Dave and Joneshousehold) |

| | Platinum Account Customer | Re: Abbey Data Protection Act Question I have just drafted this email to be sent to Abbey solicitors, I will copy it to them by post too.
What does anyone think ?
Claim: *******
Account No: ******* Dear Mr Cook Thankyou for your letter dated 22nd May 2006 which I received today, requesting further details regarding my claim against your client, Abbey, for the sum of £982.00. Your client will have details of the transactions from which the amount is calculated, as they have been taken from the account statements provided to me by your client.
For your reference however, I attach below a full list of the disputed transactions. Yours sincerely
THEN I HAVE PASTED THE SPREADSHEET BIT from the 8% calculation where I typed out all my charges, reasons, amounts and dates. |

| | Platinum Account Customer | Re: Abbey Data Protection Act Question I despair of Abbey - they have sent me a THIRD set of statements for the past 14 months ! Two random printouts 'Contact Staff' showing only 1 month each, and NOTHING before March 2005.
I feel sorry for people who need copies of statements for mortgage applications and stuff at the moment, I expect they are treating all customers with the same contempt..... |
