Default Bailiff Company Caught In The Act **!!Won!!**

I will once i get a reply tell you which bailiff company i have been chasin over the last 6 months or so. they owe me approx £800 all including the interest and also costs etc. They would not budge despite sendding them various pieces of paperwork etc. I threatned them with legal action and again no joy. Just the usual fob off letter from them. How ever as i was really nice to them bearing in mind the christmas spirit. Uncle scrooge issued against them in a small claims court. Since the issue i have been contacted by this companies legal team several times offering a settlement(half way). They have until monday to file a acknowledgement. I again spoke to them today. They have confrimed that they would rather settle out than goto court and explain their charges to a district judge. Tommorrow i will find out what they are saying. Hopefully a full settlement. I will keep you posted and Then everybody can fight back or get the courage to. A major bailiff company does not really want to go infront of a judge and explain its costs to them especially under oath.

I am doing a similar thinbg with another company they will really get it in the face when it happens. The Subject Access Request is a great thing to start off with. you need to adapt it to your specific case. Be it anything. i have wound my local council up with this and they are pressed off. They have 1 week left if no reply then i will be issuing against them and see what they say in court !!!!

I sent one off to a debt collection agency a couple of weeks ago they sent me a form back asking for everything but DNA to prove my identity and told me the 40 days would start when they were satisfied as to my identity. That was their first mistake.

janquinney - but I take it they had not got any problems with your identity when they hounded you previously??

These comapnies make me laugh - they think they are so above the law and laws will change specifically for their own purposes!!!

Go get 'em!!!! I hope you win and get what you want from them

Oh no Elizabeth, none at all, in fact they had sent me a letter containing the outstanding balance only weeks before. I think its a good indication of how things are going to go though so I'm prepared for a fight.

I actually successfully claimed a lot of charges back from a big Bailiff company back in the summer. I did it very discreetly (I think Elsinore knew I did it as I got lots of help), didn't end up in a court summons and the director of the company turned up at our house to have a chat and ended up leaving a wad of cash with us

No!! anybody wants to join no problems. Bailiffs are ass***** they think they are above the law. Bo******. Anyway the way to get them is easy if you play your cards right. the way they work is they will not refund. Unless you issue against them. However when you issue you must have made completely sure that you have given the filthy company enough chances. Even if it means writing off several times. You need to send the S.A.R - (Subject Access Request) off. The bailiffs companies will send you all the details if not drag them to court for this. Anyway once you have done this they will come grovelling to you as the last thing they want to do is face the judge and also explain why they are defending a case in court bearing in mind the history of it. Also what you must realise is that if you complain about a bailiff it will got to a circuit judge. How ever when you issue in a small claims court this will go in front of a district judge. Also my complaint had already gone twice to the qc in my case and the qcs threw it out both times saying the bailiff is not at fault the company is. As the companies set their own charges etc. what a load of cack. Now when i have finally issued this they have not defended it with the previous. As if they did it would screw things up even more for them. It takes anybody 5 mins to print out a summons. Also it takes just 5 mins to obtain a judgement and also a further 5 mins to apply for a warrant of execution. What this bailiff company did not want was eventually to have bailiffs from the courts turn up. More agro for them. Once as promised i will update also name the company in question and also post everything that happend from day 1 to settlement. As there is no settlement clause then i am able to publish. read it and then gear up yourselves to chase the bailiffs and really really tickle their tackle with your cactus plant !!!!!!

Right now here we go!
in january last year two heavies(bailiffs) turned up from : ccs enforcement services. they were there to collect a car fine(pcn) shame as there was a application to file a late stat dec in progress. As they had turned up at 6 am the time was in their favour. Someone from my household let them in when they asked for me. I was asleep at that time. I woke up and discovered that they had let the bailiffs in. Anyway pointless in arguing paid them what they wanted. Bailiff a mr marsh threatned to remove what ever he could if no payment was forthcoming. Anyway i knew what was what but family did not. Afterwards my late stat dec was accepted by the courts and it was my turn to play tickle my tckle with them. I phoned their offices up every other day until after 3 weeks somebody took notice and said send us the revoking order from the tec. which idi send them 3 times. They never recieved it. Despite it being sent by recorded delivery. Also at that time the bailiffs were operating from a croydon adress Aand they had satarted a move to their current address in the midlands. Anyway as the trail had gone cold i let it go with the odd letter going off to ccs etc. The local authority did their bit and refunded the £95 that was passed to them from ccs but would not confirm anything.
They would not confirm what thier contrract said regarding the fees charged. Alsi at the same time ccs would not reply to this.time went past and i started to further read up on bailiff laws etc. That is until ccs appeared on whistleblower. soon after a month an a bit idiscovered this site. I sent my S.A.R - (Subject Access Request) off got the reply and also a breakdown which showed 5 charges ranged from £35.00 to £169.00 I challenged this 3 times and got the same reply . We are not going to refund. In beteween there were th calls and other letters etc. I eventually first week of december issued a n1 against them. when i chased this recently i was put through to the litigation manager who said we are reviewing the file. Today i recieved a cheque for £601.88 and a letter saying that because of the client instructions there had been a mix and we enclose our cheque for £601.88 Anyway. this is a far longer story but i have cut it short. I am now waiting for the intrest to be paid. Which is £90 odd quid and also i put an admin of £150 on globally from jan 05 to the date of issue. I am curently waiting for the courts to see what is happenning. If anybody want s details of this forms and letters etc then i will be happy to supply them. The trick in this is that the bailiff company do not want to go before a judge and explain their charges and be booed off in court. Alot of people think this. I Had already been down the route of complaining to the court where the cert has been issued etc. To no avail. If you issue a small claim then regardless the ther party has to explain themselves.
