Hi

i am hoping someone can advise me,
i am going to write this in very simple terms as i am shaking and crying.

NOTE at this moment in time no bailiff has even knocked on my door

Rundle & co contacted me and i began an arrangement with them for £75 per month. this was all they said they would accept.

i only made one payment since feb. that is the only payment i have made them.

I called them today as recieved another letter. they put me through directly to bailiff who was very abrupt and said no arrangements can be made he is attending tomorrow to remove goods.

i did a bit of reading and realised amount he stated to be more than when i made original payment.

contacted council and they said amount passed on was for £766.50 yet bailiff quoted £965

i then called him again and said i had been trying to find out my rights and was confused about the amounts and asked him again to set up an arrangement with me.

he said no and that his working hours were between 5am and 9pm and that i may get a call later today

he said 'i am now going to do all i can to recover the amount owed'
and that 'once it gets to recovery stage fees are applied'

confused scared and crying

my daughter has autism and hates loud noises etc and stress...this is going to be awful.

i can't talk to the bailiff iin person...'m too much of a wimp and will become a quivering wreck.

i understand its my own fault for falling behind last year but please don't be too harsh with me

is he going to knock on my door tonight???

how long will he wait around if i don't answer?
what if he gets the police involved?

Hi ,
Firstly dont panic.
This is the law.
He cannot force entry into your home,without first having gained peacefull entry , which he hasnt

He has no walking possession,so he cant attend to sieze goods

He also has no valid levy

You can also submit a form 4 complaint to the court about his actions
Just calm down,there are some great heads on this forum who know more than me who will be along to help you soon

I am using this reply as a chance to subscribe to your thread

pleae do not get too worked up i know its easy for ppl to say that i too have a child with Autism (a son whos 6) and i know how things like this seem so hard to deal with when you have autistic child to look after just look at it like thier presence is affecting your daughter that should give you the courage to tell them (through the letter box) if you have to to do one

I am sure a wiser CAG,er will be along any second please don,t worry

This is exactly the state they like their victims to be in,everything these people do is based on instilling fear and intimidation,when in fact they have very little powers when it comes to council tax

Thats not going to happen sarah,if they do call,which i doubt they will,tell them (through the letter box) that the wont be coming in.
If they still will not go phone the police and tell them there is somone at your door who wont go and you belive there is going to be a breach of the peace,dont say its a bailiff,because if you do they wont react as quick

I know it won't realy make you feel any better but they are trying to bully you and make you feel this way. Hopefull Tomtubby will be along soon if no PM her, sorry not to be more helpful but I no longer do Bailiff work, but be strong you will get through this and you will get enormous support from here.

Hi Sarah,
What you need to do TODAY is write to the council (recorded) explaining your situation and stressing you are a "cant pay" and not a "wont pay".

Ask them to take the debt back and remind them that they have aduty of care towards you and your daughter,its important to mention the duty of care aspect as this can carry a lot of weight

my parents have said they will help me by paying so i can pay them back in small amounts.... its not quite 1000 in total, pretty sure it should be around 765

at least thats what the council passed on to rundle -but theni did make one £75 payment to them over phone once... so should really be less...if i request breakdown of charges afterwards can i reclaim amount back (or can my parents) if it is wrong???

This is a wake up call I'm afraid.

If a payment arrangement is made with a bailiff co on for instance the 14th of the month to pay monthly, most people will think that means the next payment is due by the END of the next month. Not bailiff companies. The payment date will be set in their computers for the 14th of each month and will generate a "van/removal" visits just one day after the day of the month that you made your agreement. That is why we ALWAYS advise clients to WRITE to the bailiff co to confirm what agreement has been made wit their bailiffs.

Has the bailiff been into your home?

Have you signed anything?

Can you send me a private message to let me know the name of the actual bailiff.

PS: I have just read your new post. Be CAREFUL. I say this because it is already clear that this bailiff has tried to charge over £200 without any explanation. If the bailiff knew that you could quite easily lay your hands on £1,000 then I'm afraid you may well find yet ANOTHER attempted van visit.

If the bailiff co do not provide an immediate explanation then I am minded to advice that your payment is made instead to the council. But again...be CAREFUL as they could credit the amount against this year's account.
