Default Arrested Bank Account

hi
not sure im in the correct plaCE,today i found out that all funds in my bank have been arrested bt sherriff officers ,im living in scotland and my income is mostly benefits and a bursury,im astudent nurse, ive 6 kids and they left me penniless i ned to borrow from family now as ive no money for food, school dinners, gas electricity, petrol, rent, never mind dd. just not sure what to do?
has any one advice

I don't know anything about the Scottish system, but they can't take all your money and leave your kids without.
It could become a minefield, the only thing I can think of is social services. With it being the weekend you're not going to get any joy until monday.
Then I would complain to a senior revenues officer, get a mini statement of your account, to prove they have left you with nothing. If you have no joy with the revenues officer ask for your MPs details, that may shake them up a bit.
And get through the weekend as best you can...................... .....
hang on!!! penny just dropped!!!! how did they take your money? you agreed to pay by DD? if so ring your bank and ask them to do a claim back
now be careful, because if they have a DD then that means you have given them permission to take your money, I wouldn't tell the bank that but its up to you. I'd say its not due to go out yet, and will leave you with insufficient funds to pay your other DDs. Also ask the bank about a standing order, that way you say how much they can take.

they arrested my bank account by transfer,didnt give them permission .i was told as its tax credits and family allowance thats exempt.
i will keep u posted what happens on monday.
thank god ive great parents who wont see us starve but the litteraly left us with nothing

yesterday i went to the cab
the lady there called the sherriff officers and told them that the arrestment was made of child tax credits and family allowance.
she asked them to pay it back
they asked for proof that the payment s are not savings and thats been faxed.
but since then ive landed bank charges for un paid dd
its not fair cos i had the money for those bills and they (sherriff officers)took it want to say stole it might be harsh but i feel robbed cos now im debt to the bank for charges.
im over 1000 in debt for this months bills next month that will get bigger.
please is this legal to make FAMILY suffer so bad

Hi Worr

No its not right that this is happening to you, I suggest you go back to the CAB and ask them how to lodge an official complaint against the bailiffs. And the council, for that matter, if you have claimed for council tax rebate, then the council will know your circumstances and should have taken that into account when instructing the baillifs.
Its going to be tough but keep your chin up and hopefully you'll succeed. Another thing ask the CAB if you can claim the bank charges from the council/bailiffs.

Have you got a friendly GP? He/she could help but I fear this could lead into murky waters. But maybe they can suggest someone who could help.
If you're a single parent, someone like gingerbread may have ideas.

In Scotland the system is different.

A summary warrant is already given when passed to sheriff officers.

Is this HML?

As you have alreday sent proof that it has been tax credits etc, send them an income and exp letter asap with your proposal of payment, include the first payment if you can and try and keep to this.

Our business deals just with bailiff problems in the UK and the situation in scotland is so very different.

The Sheriff Officer will have to get you to sign a mandate before they can recall the arrestment.

I am unsure what this debt relates to. If it is council tax then you need to IMMEDIATELY contact the council to ask them to release the arresment. They can authorise this.

ive got good news
this morning the sherriff officers released my funds and agreed to a weekly payment of 13 pounds a week. i could cry.
the C.A.B were fab and im going down to thank them so much a sthe lady there was just fab!
also i have to say that reading these boards kept up my spirits
