Default Walking Posession help

Hi, I've been paying a debt off since last Nov at £297 a month which has left us tight for money since then.

We've made every payment and have 2 left. However we are currently paying another council debt to bailiffs which has a walking posession order. the previous one (£297) had one on it when it started bit was only for the innital amount but the rest of the debt got added which cancelled out the walking posession order.

I've been told that bailiff's can't put a walking posession on your good's if it's already been done by another bailiff company.

What I want to know is as we are unable to pay this £297 this month as we don't have enough money what can they do?

I called to try an put it off but they said if it's not paid by 14th they will send bailiff's out to put a walking posession order on our goods an arrange to make payments. But how can they if theirs already a posession order on our good by someone else and what will happen then?

Urgent advice needed!!

The first company have a walking possession and therefore nobody else can levy upon those goods.

The bailiff company knows that this is so.......but hopes that you do not.

So what can they do then? if theirs already a posession order on my good what steps will they take then.

I've not missed any payments an I've only 2 left to make but simply can't afford it this month.

You need to WRITE by e-mail and hard copy (registered) to inform them that you cannot pay this month but that you are aware of your rights and will not allow a bailiff peaceful entry into your home.

Advise them also that there is a previous Walking Possession in place for another debt and that this WP is preferential.

State clearly that if they are to send a bailiff to your home when they have previously been made aware of your circumstances then you will consider a formal compaint about the bailiff as their actions are almost certainly an attempt to NOT collect the debt but to incur fees and charges to their company at your expense.

UPDATE:

I got in contact with the Bailiff's again and asked what would happen if I didn not pay this payment. the response was " we will send a bailiff around to arrange a payment plan" I mentioned we already have a walking possession order on our good and she said they needed to see a copy of that and that they would contact that bailiff company to sort something out. If they can't resolve it then it will be given back to the council who will decide prison or not.

I've sent them a copy of the walking possession order along with a letter requesting to put this months payment back a month and explaining why etc. If they refuse this then I will just simply pay the amount and see if they will go any further. After all by the time they get anything done the outstanding will be cleared.
