Hi
I have just calmed down after a bailiff called today over a liability order for council tax (despite my having written to them using Zoomans letter to which they responded with the usual threats to removal my goods and chattels), through a process of intimidation and threats he bullied my wife into a walking possesion order.
This person told my wife that if she didn't let him in she would be guilty of ''preventing an officer of the court from carrying out his legal duty'' and that she could be subject to immediate arrest, and that he was legally allowed to enter at any time and that she could not stop him. he said the options available to her were, he leaves and returns to do a closed possesion, he gets a warrant to break in at any time of day, he could have her arrested, or he would return the liability order to the council who would definately have her commited to prison. or she could agree to a walking possession order and that he would make an arraingment with her to clear the debt. This person coerced my wife into agreeing to pay £140 pm and tried to make it sound as if he was doing her a favour, he told her to ignore me as I wasn't the one who would be going to prison.

we have tried to get our local counciler involved but after 15 phone calls and 10 emails we only recieved 2 emails back saying he would look in to it about as much use as a chocolate teapot
we've also tried to speak to the council but they were not interested just seemed to think that we would default on this years council tax as well, we have a very forward thinking council they employ clairvoyants in their income recovery office
I was thinking of filling out a F4 to complain about him I've already checked and he is certificated though he claims to be a court bailiff. I did manage to record some of the things he was saying just have to check that they have come out clearly so I can transcribe them.

As a seperte item I was sent a letter by Equita who named a bailiff and said he was coming to my home to collect the council tax, when I checked with the enforcement office he was not and had never been certificated.

any help would be very much appreciated

It's sounds as if you've calmed down - not

Becareful what you say in these threads, yes they do frequent this and other threads so I would delete a section of your post.

My initial thought is to contact The National Debtline and seek their advice. Even if it satisfies your own mind what you have todo and that you are thinking correctly. Transcribe the tape as quick as possible and use it as defence if you go down the Form 4 route.

Thanks for the advice Kel, having calmed down a bit more (although I'm still spitting feathers when I think what happened, should have stayed on the anger management course) I've edited my post if you see anything else that needs amending please let me know.

We did get a call from him saying that the debt had been reduced by the council but he did not explain why.

I'm going to ring the national debtline on monday I should be back to normal by then
