Default Bailiff refusing payment please help

Hi

Can anyone advise me please.

A friend has signed a walking possession agreement with rossendales bailiffs for council tax. They agreed for her to pay an amount today and the rest by the end of the month. When the bailiff turned up today the amount he had agreed to had gone up by £110. She had the amount he originally wanted in her hand and tried to give it to him but he refused point blank to take it and has told her he will be coming back on friday to remove goods. He scuttled off once my husband appeared to find out what the problem was!!! The bailiff then drove round the corner and phoned my friend and gave her a load of abuse on the phone.

Where does my friend go from here. I am going down the council with her to try and sort something out but i want to know how she stands on this and if she pays the money refused by the bailiff direct to the council does this change anything

Any help much appreciated

This is yet another example as to why our company have to now advise that you do not allow a bailiff into your home and do not sign a walking possession.

The action of this bailiff is awful. The council MUST be informed immediately and I would be asking the to bring the account back into their control. Your friend should also make a note of everything that the bailiff said to her on the phone. This is important as she can make a formal complaint about this bailiff.

Can you send me a private message with the name of the bailiff so that I can search to ensure that he is certificated.

Right i've been to the council with her and they gave the usual guff about not their problem. Although they did phone bailiff and tell him he should of taken payment.

The bailiff rang my friend while still in the council and came to a verbal agreement over the phone to accept £30 a month.

Now i have managed to get the council to accept a payment by card that discharges one liability order. (he was collecting on 2 liability orders)

The bailiff is now saying that because my friend has cleared one liability with council (less his costs) that he now cannot accept an arrangement for the other liability order until his costs are paid.

Can he do this?
Can he enforce the walking possession to recover just his costs? ( she has 2 walking possession agreements, one for each liability)
Can he add the costs that she didnt pay onto the other liability order?

Hope all this makes sense

ok so bailiff has rang again and said that unless costs are paid by the end of today he will remove goods on friday. He says that he has spoken to council and they dont want to accept an arrangement on this 2nd liability order but he has worked hard and got them to agree that she can if she pays mr thug his costs that are outstanding. Oh and he also told her to stop talking and listening to me as i know nothing and i am causing her more problems.

Don't take this as cospel but I thought that were council Tax is concerned and there was 2 or more liabilities then they run consecutive not concurant starting with the earliest first.

Maybe others know for sure?

Are you absolutely certain this is what the council has said to the bailiff?

I think I would confirm with the council this is correct. Did you send tomtubby that information so he could check if this bailiff was certified

Yes i did and the reply was interesting! I have passed the information on and hopefully she will act on it. I think at the moment the thug has her worried and she's taking what he says as gospel, even tho he has now admitted he was 'confused' and didnt mean to try and overcharge her this morning

arghh this is precisely why I hate bailiffs, they really will do and say anything to get money, I just wish more people knew their rights as it would save so many people from getting so stressed and upset by them
