Default walk in possession agreement

Hi, i was wondering if anyone can help with some information please. I will outline the problem but the exact dates and cash paid is known by my wife and i can post them tomorrow morning. Basicaly we owed around £150 for council tax from a previous address and about 1 month ago a bailiff called, with a bill for about £300 (this included his charges). We never let him in but rang him later. We paid about half of it to him about 2 weeks later. The rest was to be paid at £50 a month. One of our payments was a few days late reaching the office ( they sent us a reciept). Now today out of the blue he has called again with another bill of £400, no one was home so it was pushed through the letter box. The letter is saying we had broken the walking possession agreement. He has never been in our house and as far as i know, no agreement was signed. This letter says they are now attending next week with a locksmith and police to gain entry. What can be done about this? and also the charges seem stupidly high, can we check anywhere? Any help and advice would be of great help.

Fees are totally incorrect.

I am away from my office until late tomorrow so can respond further when I return. In the meantime can you let me have the name of the bailiff and the company that he works for and I will check our database to ensure that he is certificated.

Hi, thank you. The company is called phoenix commercial collections and are based in Bolton. The bailiff name on the paper is just a unreadable signiture. Jeff mc something.Sorry i can not be of more help.

Hi, my wife is here now so i can update with the proper details. On the bailifs first visit on the 7th of feb this year we actually owed £303 council tax he put £200 on top for his fees bringing it up to £503. We paid £200 cash to him when he called for it on 20/02/08 (we have reciept). The remainder was to be paid at £50 per month on the 20th. Due to my wife not being paid by the end of the month marches £50 was late but it was paid (again we have receipt). So balance should of been £250. We have another £50 we were going to send now but as i say we now have this letter and the new balance is £403. I have just read the bailifs name of the first visit was stephen petrie (appears to be a different one that called yesterday).

Hi again, last bit of info now ive found out from the wife. When the bailiff came to collect the £200 he was on the driveway outside he never entered the house at all but did ask whos car was on the drive it was my sons so never mentioned it again but was asking my wife it we had a tv, microwave etc and was writing it down

My wife is not 100% sure as she was asked to sign to say we would agree to pay the £50 per month. We are now thinking it was just a trick tactic to sign the order. After many phone calls today ( armed with info off this great site, Thanks ) They have now wiped off the latest £150 they tried to put on top yesterday. Our bill is now down to £250 again and we can pay at the office (without seeing the bailiffs stupid face again). A small breakthrough but it still does not alter we were charged £200 for his first visit. I have just printed off an access request form and will be sending it straight away waiting to complain about the bailiff to the courts.
