Default Paying money but still they send bailiffs?????

I owe to the council or to dues bailiffs £348.72. They origionally requested that i pay £81.50 per week. As my Partner is on low income and i am currently on maternity leave we can not afford this. Theefore i sent a letter back saying that we can't afford it and tat we would pay £20 per week. I also said that i had enclosed a first payment of £20 so that we can start reducing our debt until a proper pay arangment could be meade.

they have not sent me a letter back to arrange a payment agreement but have sent me receipts of the last 4 £20 i have been paying in the last four weeks. ~

However, this morning they sent a bailiffs round to see what property i had to evaluate what could be held in their possession (i.e that i could not sell until the debt has been paid).

I didn't think they could send bailiffs round i i was paying th debt!!!


Help i dont know what to do!!!!

No, i told him that i wouldn't let him in as i was in talks with them about arranging a payment agrement and after some banter and him asking me to let him in about 7 times and trying to ake me sign an agreement which i didn't sign he went. How can i prevent them from coming around to my prperty again?

You had an agreed repayment structure with the council and they have reneged on it and you are on a low income. You have grounds to file a complaint of misfeasance against the council with the LGO, so get that on its way ASAP given the urgency of the matter. Ask the council why they have send bailiffs, if its an error then you can ask the LGO for compensation because the council made a mistake.

NEVER open the door to a bailiff and ALWAYS speak to a bailiff through a window or letterbox. If you can, throw them a letter based on (EDIT) to tell them they are not being given access to your goods and property. It revokes a walking possessions fee and an attending to remove fee. If you want to post the letter to the bailiff then use (EDIT) instead and cc a copy to the council.

If you ever feel threatened, intimidated or a bailiff threatens you with a locksmith then you should call police on 999 reporting a robbery in progress with a suspect on the premises.

Bailiffs can only be sent if the council has a liability order - did you receive one? its a Form B.

The bailiff tried to trick you into signing a walking possessions agreement telling you it was something else - such as confirmation of visit - you did the right thing by not signing but this now gives you grounds to make an official complaint against the bailiff for attempting to defraud you because that signature would have enabled the bailiff to charge to a walking possessions fee.

If you know the bailiffs name, then (EDIT) and report back of you find an irregularity.

Also i think they have put charges on for the wrong reason. Two days ago the bailiffs came round, they did not knock or ring the buzzer. they did however post a letter saying that they called at my property and i was unavailable etc etc.... they letter clearly states that i was unavailable

however i was there when they posted the letter and even saw him walk away back up my driveway yet he had not even bothered to knock.

They have put charges on my account for this!! is this wrong?

if so what can i do about it? e.g what do i say/put in a letter to them?

write to the bailiff with this letter and ask them to remove the fees and say why.

Write to the council with (EDIT) and tell them what you just saw the bailiff do.

If the council is uncooperative then file a complaint of misfeasanc. Theye with the LGO. This is corruption because the bailiff is relying on GPS to verify a visit when they didnt knock the door and just posted a note. They are trying to artificially inflate their fees and defraud the debtor.

If the bailiff gets funny then make a form 4 complaint to be placed before the certificating judge to explain why they are trying to defraud you (EDIT)

Equita are big on this so I'd inform police they are comitting fraud on a wider scale and systematically and routinely defrauding consumers en-masse. (EDIT). It needs to be brought to the attention of the authorities.
