Default Notice of Issue of Warrant of Execution

Hi

My wife has just received a notice of warrant of execution. Basically the creditor attatched the debt onto the house. We didnt think we needed to pay anything. I though they did this for thier own security. Nieve I know.

My wife received this letter with an amount to pay. My wife and I can not afford this amount. She has phoned the court and asked for a N245 form. Is this correct? Also I am not sure how quick the turn around will be with the form and giving it back. The date the payment needs to reach the court by is 8th March.

It mentions that a bailiff will come round. Can my wife refuse thier entry? I am not sure if this would be different to other bailiffs if this is from the court house? Are all the bailiff rules the same? If my wife is out can they break in?

Any advice would be really appreciated. I wish I wasnt that nieve not to pay it. Anyhow I have lived and learnt by this. I just want to get this sorted and pay back some money that I can afford.

County Court bailiffs are relatively easy to deal with (as they are paid a salary and have no financial gain to make by bending the rules and adding ficticious charges etc).

They cannot break in - so keep doors and windows closed so they cannot gain "peaceful entry" by opening a door for example. Yes - you CAN refuse entry (in fact you MUST do !).

Many firms are now "turning" non secured debts (ie credit cards) into "secured debts" by charging against the property. I doubt a Court would ever force a sale so the debt can be paid, but this is the way things appear to be going.

Tell the Court what you can afford to pay (make sure that all essentials are deducted first) and the Court will acept that, I'm sure.

Above all - don't worry,

Thank you for your help. I will get all the forms done and draw up a budget tonight.
