I would like links to, or a leads on where I can obtain the following.
  • A copy of the schedule of prescribed fees?
  • The legislation or law(s) requiring a bailiff to adhere to them?
  • Form 4, if it exists, for making a complaint about a bailiff?
The ones on this forum appear to be out of date and doesn't reflect apparent changes in Jan 08.

Any info greatly appreciated.

I have asked the moderators many times whether I am allowed to put all of the fee scales from our website on the sticky section for everyone to access for free, but so far.....not allowed I'm afriad.

If you let me know which ones you want I can at least copy some on here for you.

All schedules of prescribed fees (except HMCS). A downloadable Form 4 complaint form, and any legisaltion requiring bailiffs to adhere to prescribed fees. You can PM it if you like. If pos the schedules before & after jan 2008 watershed - I hear they were amended.

But this has been available for ages.

What i want is the legislation governing what they can charge as their admin charges.

I dont believe they can charge £800+ for one visit and one first class letter.

Sorry, was`nt clear you wanted the Statutory Instrument.
HCEO use the same fees as Sheriff`s and Under Sheriff`s, also known as the Act of Sederunt.

The only up to date reference I can found to fees is here

(2007, in force as of 14/01/0

Act of Sederunt (Fees of Sheriff Officers) 2007 No. 550

It is unclear however if this also applys to England & Wales, further references to Sheriff Fees (which have increased on several occasions over the years) show not only reference to Scottish Law but also to English SI.

Anybody else, any the wiser?

The above applies to Scotland only which is a shame as their fee scale is so much clearer and easier to understand.

The only other reference I can find is based on a green paper that the DCA produced.

The Sheriff's Fees Order 1920
Department for Constitutional Affairs -

As tomtubby has pointed out. the Scottish SI is much easier to read and understand.

Anybody else want to chip in?

I have been charged £1068 for one visit, (No removal of goods !) i haven't even had the privilege of a first class letter !
