Bailliffs do what they want!

My car was taken on the 20/11/07 by Equita,it is also still subject to hp agreement.I have been told that they are not allowed to do this but need to know if this info is right...
I went to the police station but they were not much help as they told me it was a civil matter and that if they were called when it was being taken then the car would remain with me but as equita have it now there is nothing they can do so i should just pay them.
This is easyer said then done as this year i have paid one bailliff company £3,000 already and i really can afford to keep doing this so if anyone has any advise for me i will be over the moon.....thanks

Contact the finance company who owns your car. Ask them if they authorised the car's removal. If they didn't, let them deal with Equita directly. Equita will return the vehicle at their own expense as soon as your finance company threatens legal action. If the finance company don't want to get involved (unlikely), tell them you'll cancel the direct debit to them immediately. You should have the car back by tomorrow night if you get on to it tomorrow morning.

they towed the over parking tickets which l foolishly ignored peugeot say there is nothing there can do as the bailiff have said they are not going to sell it only keep it untill l pay which l cant do and they wont come to any arrangement with payment l have been to the police and they say they cant help yet the bailiffs law say they cant take a car on hp what more can l do they have had the car since nov and they wont even talk to me now unless l talk money lm so desperate somebody help me please

I'm shocked at Peugeot's stance. You have nothing to lose threatening to stop the payments to them. Try it tomorrow and see how high they jump. Get tuff with them. It's their car at the end of the day and if you stop the payments they'll want their car back!!

I'm sure if you get to speak to the right person at Peugeot and tell them your intentions they'll do something more constructive than fob you off with pathetic excuses. If that doesn't work, I'm sure someone on here will be able to help you recover the money you've paid Peugeot so far for the car.

In the fist instance can you please let me know by PRIVATE MESSAGE ONLY the name of the bailiff that removed your car so that I can search our register to ensure that he is legally certificated.

You need to also contact the Traffic Enforcement Centre to ask the the date that the Warrant of Execution was authorised. This is vitally important. You will need to provide the PCN number.

Default got car back from eqiuta thanks to tomtubby

l want to say a big thank to tomtubby who has helped me get my car back that was taken in november it is on hp and even though we now know they cant take a car on hp l couldnt get any help from ie police,citizens advice and even solicitors who actually said l didnt have a leg to stand on l was at my wits end untill l got a message from tomtubby who has been my god send and was always at the end of a phone and always ansered my calls when she was out and came back to my messages l know equita wern't happy and they should obey the baliffs law when it says you cant take a car on hp.anyway once again thanks tomtubby

Thank you so much. This was a very unpleasant case and one that bailiff companies should be embarrassed about. It is one of the most clear cut cases of bailiff law ie: that a vehicle subject the HP CANNOT be seized.

And yet, despite this, this particular bailiff not only removed the vehicle, but kept it in the vehicle pound for over 2 months. !!!

There is more work going on in the background, but at least the vehicle is now back where it belongs.
