Default Help Needed Please.

Right, are you sitting comfortably, then I will begin.

I was self employed and I decided to give up my business. I was aware that I owed money to a company, so when I closed my buiness I wrote to them and told them I was closing, can I have a bill and gave them my address to send any correspondence too.

I heard nothing. So rather stupidly I never chased it up. Anyway, 2 YEARS later I received a leter through my door from an high court enforcement company threatening to take my car.

I called them up - explained the situtation. Apparently the debt had already gone to court and they had sent me numerous letters but guess what to an address that I had not lived at for 5 years. Hence I never received anything. So you can imagine, how many fees and charges have put onto this bill. As I didn't want them to take my good I agreed to pay them an amount each month. The charges are in excess of £1000 plus the bill. I wrote to them and explained this but they said I had to pay everything. I was also pregnant at the time when this letter popped throught my door and since then I have miscarried. I am not saying I blame them but the stress can not have helped.

Is there any way I can claim back any charges etc. Any help would be apprreciated.

Check with the Court that issued the summons. Tell them that as they used
the wrong address, you never received any notification of the outstanding bill, the Court case or the Judgement.
You are therefore asking for the case to heard in your presence as you feel
aggrieved that the case had even gone to Court since you had written to the company involved asking for the bill and supplying them with the address you
are staying at now.
And the Court should rehear the case with you being present this time. Once you have the form to fill in from the Court, send it off quickly to stop the
bailiffs coming to see you. Probably best to make a personal visit to the Court if you can.

The Court have a form that you fill in to apply for a rehearing. If the Court decide on a lower figure you will be reimbursed the overpayment. But contact the Court quickly before the bailiffs xall as that will add to the cost.
