Cool Letter before Action

Firstly, how the heck do I find my last thread on this forum. Secondly I am just putting together the info for the LBA BUT I don't understand part of it, can someone explain please.

I calculate that you have taken £XXXXX plus £XXX which you have charged me in overdraft interest for the sum which you have taken. Total £XXXXX."

I don't understand the bit about plus £XXX in overdraft interest. What is this, because the forum says not to include the 8%, where do I get the figure for the overdraft interest? Sorry to be so thick, but I want to get this correct.

To find your threads go to USER CP at the top right end corner of the site. there you cab view all the threads you have subscribde to.

The interest should be on your statements.

Hi, TAG.

To find your threads, click on your username in the top left hand corner of your post, you will see something like 'find all posts by ...' and 'find all threads started by ...'. Click, and you're away!

The 8% is what you will be charging them for 'lending' them your money over the past 6 years or so; the interest you speak of is the amounts of interest they have charged you each month for being o/d, and which are listed on your statements.

Younganfree, that 8% can only be claimed when you sue and not before. The bit you can claim is interest on the charges not 8% statutory interest at court stage. If you have not claimed contractual at the start you cannot write an LBA with interest after the prelim.

Yes, Nattie, thanks, but Tag already new she couldn't claim the 8% till the court became invoved, so I didn't mention it again.
