Default Junklunacy v Alliance & Leicester

Hi All, This is my 2nd thread for claiming back charges. My first is junklunacy v Barclays which is currently at MCOL stage and awaiting Barclays defence.

With regards my A&L claim I have sent my letter for repayment on 30/12/2006 for a total of £746 excl interest. I will be giving them 14 days before I send them another letter and then a further 14 days. If i don't receive the FULL amount after this time I will be paying MCOL another visit as I have done against Barclays. End date for A&L to pay me in FULL is 27/01/2007.

I've received a fob off letter from A&L. They comment on OFT comments on late payment charges and that they were actually referring to late payment fees for credit card payments which are distinct from bank charges on current accounts bla bla bla. So another letter is on the way to A&L setting timescales for my demands etc..etc.. This WILL NOT DETER ME!! Nor should this put off any other people who receive similar letters from their banks. We must NOT let them put us down or detract us from our main objective - getting OUR cash back!!

me and helemn received exactly the same letters today from a&l...i have already sent LBA to them...up theirs...........still waiting from Capital One statements and Barclaycard said that they will charge £3 per each statement i require and i needed 6 (as all the rest of them i have) and they have only charged me £3 for the whole lot....strange

Sent A&L a letter on 8/01 to basically remind them that i'm serious and the timescales they have to meet my demands. A fob off letter will not wash here. Looking forward to their next letter.

Received a letter from A&L yesterday 12/01. They've had the 'opportunity to review why the charges were raised and considered my comments', yea right! Again they have said the charges are in line with other organisations and supplied a phone number and web address to fix all my 'problems'. These guys are heartless but not unexpected. I will be posting another letter prior to their deadline one last time and if that fails MCOL here i come.

It would appear you have to file a claim before they will pay out, but pay out they will, I did mention to the court when withdrawing my claim that they without fail say they will defend the cliam but have never yet done so, lets hope the courts are now taking some notice!

Hi
I've received the same letter from A&L as follows
' commets of OFT were referring to unfair credit card charges and had nothing to do with banks.'

they did not accept they I had been unfairly charged and couild not agree to my request for a refund of charges.

This was after my preliminary letter from library which already sets out timescales. Can I now send LBA as they have replied, even though its less than 14 days?

Personally i would stick to your timescales 14 days and another 14 days. It means if you do go to court you can say you gave the bank adequate time to deal with your case. I sent another letter after the one you received saying that i wasn't happy with the standard repsonse and that i will be submitting my claim on MCOL when the time comes. To bait them more i will remind them what I'm doing 3-4 days before I do it. Again it gives them time to reply and I'm still sticking to my timescales. In this case they have until 27/01 to give me my money otherwise i will be visiting MCOL.

I've received a 3 rd letter from A&L basically saying bugger off. I've given them more than 28 days to deal with my complaint satisfactorily but to no avail. I'm currently due in court next week for my claim with Barclays see here http://www.consumeractiongroup.co.uk...-barclays.html so as soon as that is sorted I will be filing my claim with MCOL against these people!

I have had an acknowledgement from A & L to my LBA letter saying thy are looking at it and will contact me idc. Will only wait theoriginal 28 days before I do a claim

I put my claim in to court last Thursday (7th Feb). I had a letter today offering me charges claimed plus around £200 (£1911). I have claimed £3342 with interest and actual charges are £1769. I think this letter crossed with the small claims notification.
I do not intend to acept it and will tick out for whole amount.
