Default Advice about letter received

Hi all

Received a letter from A&L this morning saying that when "the OFT made the statement about unfair charges, they were referring to late payment fees for credit cards as opposed to bank charges on current accounts". Is this correct or just a standard letter?

I got the same "Not us guv, it's only the credit card boys" letter.
I cannot find in the Unfair Contract Terms legislation anything that says thet it applies only to Credit Card contarcts or that Bank Account contracts are excluded so I sent them a Letter Before Action to which I had no response and I have initiated action via Moneyclaim online.
We shall see what transpires.

Fun this isn't it? Even if I get nothing out of this, and I cannot see that happening, just to be able to kick back at those who have so unashamedly "rogered" us for so long, is very satisfying.

I couldn't get the Bootle address (the old Giro Bank address) accepted so I entered the local branch address. There is a corporate HQ address in Leicester which might have been better but the branch address will work OK, it's inconceivable that they do not have an internal mail system.

you will, you just need plenty of patience....do everything by email if poss, anything sent snailmail must be sent recorded. If you want the address for serving documents it is: Alliance and Leicester plc,Carlton Park,NarboroughLeicester. LE19 0AL. The bootle office makes the payments....... (altho in corresponce Ive had from them, their legal dept sometimes refer to it as their bottle office (HAHA!) If you know the right amount, go for it. Good Luck (not that youll need it!)

yeah you got me i made it up i sat here wrote all that trying to big myself infront of people i will never meet.

but sadly i really had to do that i went in because i bought some stuff of ebay at the following prices 9,98,9,98,6.99,3.99,1,99 these were fake baits for fishing the charges totaled 150.00 thats all i wanted back so yes maybe i lost my rag but i have no reason to lie.

Sent the LBA to A&L and today received another letter saying that "the OFT report did not give any specific recommendation regarding the level of charges appropriate for current accounts and that there has been no consultation between the banking industry and the OFT on this matter".

Have they got a point? I am just worried about taking them to court if this defence will go in their favour.

Don't worry, they are bluffing. Ignore the letter and continue with your claim based on your timetable. I presume you used the LBA template? If so you can enter a claim at the expiration of the 14 day deadline.

The OFT report was into credit card charges, but they also commented on bank charges. The banks did not like this for obvious reasons, not least that they did not have the opportunity to discuss this with the OFT and were caught off guard when the report was published. It does not change the fact that the OFT did mention bank charges, so don't worry about it.
