Default jukesy versus Alliance & Leicester

Hi,

I have just received a response to my initial claim for my charges to be refunded from A & L. They say that the recent publicity refers to credit card charges and that the OFT have not yet entered into discussions with the banking industry about current accounts. Apparently A & L will participate in discussions as appropriate if that position changes in the future! They then say that "given the above I cannot accept you have been unfairly charged and are unable to agree to the request for a refund on this occasion".

I think they are trying it on, but could someone please confirm that the charges do apply to current accounts, before I proceed and make a claim?

Thanks anyone/everyone.

I will keep a running log posted that hopefully will help others.

Nowhere in the Unfair Contract Terms legislation does it say that it only applies to credt card contracts or that bank accounts contracts are excluded.

I got the same letter. The only information I took out of it was that A&L are refusing to refund my money.

I have sent the LBA and started a claim via Moneyclaim online.

You may also see a charge labeled "Paid Item Charge". On my statements it is merely another description for failed direct debit charge except that when the money was deducted they then made an "unauthorised overdraft charge"
I am claiming both of these charges back with interest.

Ain't life fun when you can kick back a bit after years of being "rogered".
